Civil servants who quit their jobs without permission will have to compensate for training costs.

The Ministry of Home Affairs has just announced a consultation on the draft Law on Cadres and Civil Servants (amended), which includes a proposal to resolve cases where civil servants voluntarily resign.

According to the draft Law on Cadres and Civil Servants (amended), the Ministry of Home Affairs proposed that the Government develop a roadmap and issue regulations to gradually transform the management of civil servants according to job positions within 5 years from the effective date of this law.

During the 5-year period, the management of staff, recruitment, management and use of civil servants will continue to be implemented according to Government regulations.

The draft law clearly states that commune-level cadres and civil servants according to the provisions of the 2008 Law on Cadres and Civil Servants (amended and supplemented by the Law on Amending and Supplementing a Number of Articles of the Law on Cadres and Civil Servants and the Law on Public Employees in 2019) from the effective date of this law are on the payroll of the province or centrally-run city; are ranked according to the salary scale and grade corresponding to the assigned job position if they meet the standards and conditions required by the job position; and are recruited, employed and managed according to the Government's regulations on recruitment, employment and management of civil servants.

"In case of not meeting the standards and conditions required by the job position, the competent authority shall consider and decide on streamlining according to the provisions of law at the time of streamlining," the bill clearly states.

Regarding wages and income, the draft law proposes that cadres and civil servants working in mountainous, border, island, remote, ethnic minority areas, areas with particularly difficult socio-economic conditions or in industries and occupations with toxic and dangerous environments shall enjoy allowances and preferential policies according to the provisions of law; shall enjoy overtime pay, night work pay, and other regimes according to the provisions of law.

Civil servants who are entitled to unemployment benefits at will must submit an application and receive approval from the competent authority. In cases where a civil servant voluntarily quits his/her job without the approval of the competent authority, organization or unit, he/she will not be entitled to unemployment benefits and must compensate for training and development costs according to the provisions of law.

Also according to the draft law, no dismissal will be granted to civil servants who are under disciplinary review or are being prosecuted for criminal liability. No dismissal will be granted to female civil servants who are pregnant or raising children under 36 months old, except in cases of voluntary resignation.
