Participating in the discussion, delegate Huyen expressed her agreement with the name and the necessity of promulgating the Law amending and supplementing a number of articles of the Law on People's Public Security as stated in the Government's submission and the review report of the National Defense and Security Committee.

Commenting on the draft law, the delegate raised the case of "Officers considered for promotion from Colonel to Major General must have at least 3 years of work remaining; in cases where they do not have 3 years of work remaining, the President will decide."

The delegate said: "To ensure transparency, strictness and convenience in the process of applying the law, the drafting committee needs to consider and weigh more specific and detailed regulations for cases of not having enough 3 years of work as decided by the President. It is necessary to clearly define what is not enough 3 years? Because if regulated like that, the case of missing one month, a few months or 1 year is still not enough 3 years".

"So how to apply the lack of 3 years, I think it needs to be clarified, to avoid abusing the regulations when implementing, causing unfairness for the subjects" - delegate Huyen suggested.

Regarding the regulations on early promotion and promotion of rank beyond the prescribed level for officers and non-commissioned officers: "Currently, the draft of the new amended Law has been amended in the direction of adding content assigning the Government to prescribe conditions and criteria for cases of early promotion, but has not yet amended or supplemented the regulations on criteria and conditions for promotion beyond the prescribed level" - delegate Huyen expressed her opinion.

The delegate said that such amendments and supplements are not comprehensive, although both current provisions apply to cases of exceptionally outstanding achievements in combat and in performing tasks of the Public Security sector.

The delegate recommended that the Drafting Committee study and add a new clause regulating the conditions and standards applicable to cases of early promotion and cases of promotion beyond the rank level. These conditions and standards must be principled and can be assigned to the Government to stipulate in more detail to create consistency and uniform application with other laws.

Regarding the regulation: "People's Public Security officers who are professors, associate professors, doctors, and senior experts can have their service age extended beyond 62 for men and beyond 60 for women according to Government regulations", delegate Huyen suggested that the drafting committee consider adding regulations on the specific time applicable to this regulation so as to avoid confusion in implementation when the Law is promulgated.
