Fight and prevent distortions of human rights issues in Vietnam

Việt NamViệt Nam01/12/2023

Folk games of ethnic minorities in Lam Binh district ( Tuyen Quang ) are maintained.

In recent years, the issue of democracy and human rights has been one of the key targets that hostile forces, opportunists, and reactionaries have regularly taken advantage of and exploited to sabotage our Party and State. These subjects have continuously made distorted and defamatory statements about the human rights situation in Vietnam.

Accordingly, some reports on world human rights have made inaccurate and unobjective assessments and comments on the issues of religious freedom, democracy and human rights in Vietnam. On the other hand, anti-government elements have continuously spread rumors about so-called “prisoners of conscience”, thereby taking advantage of them and demanding the right to interfere in Vietnam’s internal affairs, encouraging and inciting law-breakers, discontented and opportunistic political figures to denounce Vietnam for violating human rights.

For example, a report by the Vietnam Human Rights Network (VNHR) - one of the reactionary Vietnamese exile organizations in California, USA, has established that there are currently nearly 300 "prisoners of conscience" being held in prisons in Vietnam and nearly 80 people were arrested by the government in 2021.

Some people are called and praised on forums as “heroes” for their brave fight for democracy and human rights in Vietnam, but in reality they are people who regularly incite people to oppose the government, draft and distribute many documents against the Party and the State, defame the regime or violate state laws.

In addition, it is also necessary to mention a number of individuals who, due to personal dissatisfaction or personal purposes, regularly give interviews to foreign newspapers and radio stations, distorting and slandering Vietnam for violating democracy and human rights; even gathering forces from domestic and foreign elements and organizations, and instructing them on skills to act against the government.

The terrorist organization Viet Tan also set up the “Le Dinh Luong human rights award”, and considered this as “a concrete effort to contribute to the struggle for human rights and freedom of the Vietnamese people”!

Under the guise of advocating and protecting acts of disregarding the law, disturbing social order, violating national security, and opposing the regime, domestic opposition groups collude with hostile forces abroad to seek every opportunity to spread fabricated and untrue information in order to deceive public opinion about the mistakes and shortcomings of organizations and individuals, condemn the "weakness of the regime", and distort the guidelines, lines, and policies of the Party and State.

The purpose of these subjects is to destabilize the security and order situation; lower the prestige and position of Vietnam; incite division and cause people to lose confidence in the Party and State to serve the strategy of "peaceful evolution" and the ultimate goal is to transform the socialist regime in Vietnam.

It must be affirmed that, in the process of building civilization, Vietnam as well as other countries in the world manage society by legal means. Those who violate the law must be strictly handled according to the provisions of the law.

Vietnamese law is built in accordance with the provisions of international law and practical requirements to ensure the free development of the people, contribute to building and maintaining an orderly and stable society, and prevent organizations and individuals from taking advantage of freedom and democracy to violate human rights.

In which, respecting and ensuring human rights is a consistent and pervasive viewpoint in the Party's guidelines and policies and the policies and laws of the Vietnamese State.

The anti-government arguments put forth by opportunists, reactionaries, and hostile forces are not based on official, verified information, but on information collected through intentional copying and editing, with clear political motives to defame Vietnam.

The so-called “prisoner of conscience” is just a fabrication, a legal distortion, because when committing a crime, the subject must be investigated, prosecuted, tried publicly, sentenced and punished according to the effective decision of the court.

In Vietnam, there are absolutely no “prisoners of conscience”, there are only those who violate the law and are prosecuted and handled by the authorities in accordance with the law. Therefore, inciting or trying to protect the so-called “prisoners of conscience” is only encouraging those who violate the law and are convicted but do not serve their sentences, disguise themselves as democracy, and take advantage of democracy to sabotage the country and transform the social regime in Vietnam.

This plot can be clearly seen through the terrorist organization Viet Tan's efforts to promote, promote, and name the Le Dinh Luong human rights award - which is the name of a member of this organization, but in reality is a subject with many illegal activities.

On October 18, in Vinh City (Nghe An), the High People's Court in Hanoi opened an appeal trial for defendant Le Dinh Luong on the charge of "Activities aimed at overthrowing the people's government" under Article 79 of the 1999 Penal Code. The trial at the appeal continued to clarify that Le Dinh Luong is an especially dangerous reactionary; an active propagandist, attracting anti-government ideologies in Nghe An and Ha Tinh to join the Viet Tan organization.

Therefore, the court upheld the original verdict, declaring that defendant Le Dinh Luong was sentenced to 20 years in prison and 5 years of probation. Therefore, no one was surprised that the Le Dinh Luong Award was established only to award and promote “human rights activists” who were all lawbreakers and convicted by the court.

In fact, since its establishment, the Vietnamese State has always placed the freedom, democracy and human rights of citizens first, and this issue is clearly stipulated in the Constitution and laws. The 2013 Constitution fully stipulates the obligations and responsibilities of each citizen. Specifically, Article 15 of the 2013 Constitution clearly stipulates: Citizens' rights are inseparable from citizens' obligations; everyone has the obligation to respect the rights of others; citizens have the responsibility to fulfill their obligations to the State and society; the exercise of human rights and citizens' rights must not infringe upon national and ethnic interests, the rights and legitimate interests of others.

Vietnamese citizens are guaranteed human rights such as freedom of speech, freedom of the press, freedom of belief, religion, freedom of association, the right to complain and denounce... The law respects and protects the thoughts, wills and aspirations of each organization and individual if they are consistent with the spirit of building and upholding the law, and consistent with the ethical standards and cultural traditions of the nation.

At the same time, if organizations and individuals have bad intentions, impure motives, and use the excuse of freedom, democracy, and human rights to trample on the legitimate rights and interests of organizations and individuals, and infringe upon the interests of the State, they must all be subject to corresponding sanctions.

With a people-centered approach, prioritizing human development and promoting equality in the country's socio-economic development strategies and plans, Vietnam has made tireless efforts over the years to promote and ensure human rights.

Many achievements in ensuring human rights in Vietnam have been highly appreciated by United Nations organizations. Vietnam is worthy of its role as a member of the United Nations Human Rights Council for the 2023-2025 term. In recent times, Vietnam has actively participated in and chaired resolutions promoting the Universal Declaration of Human Rights, climate change and human rights, etc., thereby making many practical contributions to the activities of the United Nations.

Vietnam is always open to learning and striving to do better in ensuring human rights for all people. In many official reports of Vietnam to the United Nations human rights agencies, it has frankly and directly mentioned the difficulties Vietnam has encountered in human rights work, thereby proposing solutions for improvement in the coming time.

In reality, although many socio-economic achievements have been made with rapid and stable growth rates, and with support and attention from the Government, the country's resources are still limited, so the infrastructure of education, science, culture, sports, health, etc. is still lacking, affecting the full enjoyment of people's rights, especially in mountainous areas, islands, remote areas.

The current legal system is still lacking in synchronization and not really close to reality. However, the determination of the entire Party and people is that “no one is left behind” and to achieve that, we need the joint efforts, companionship and determination of the entire society.

In the current context, there are people with dark intentions, lacking responsibility towards the country and the community, deliberately taking advantage of freedom and democracy to harm the interests of the State and organizations and individuals; often using the guise of freedom, democracy and human rights to sabotage the Party, the State and the socialist regime.

In order not to be misled by bad people and believe in false arguments, each person needs to raise awareness, be alert and vigilant against unofficial information that distorts the guarantee of human rights in Vietnam. Individuals, within their actual conditions and capabilities, need to actively participate in contributing to the country's development process; proactively fight, prevent and defeat the plots and sabotage tricks of hostile and reactionary forces.
