National Assembly deputies of Bac Kan discuss the draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution.

BBK - On the afternoon of May 7, the National Assembly discussed in Groups the draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution, the draft Law on Organization of Local Government (amended) and the draft Law on Cadres and Civil Servants (amended).

Participating in the discussion at Group 11 (including the National Assembly delegations of Bac Kan , Vinh Long, Son La and Long An provinces), the National Assembly deputies of Bac Kan province enthusiastically discussed and basically agreed with the general viewpoint of amending and supplementing the Constitution, as well as the draft laws because this is truly an urgent issue, aiming to meet the requirements of restructuring the apparatus in the new period, and at the same time contributed many practical and specific opinions to the content of the above drafts.

Commenting on the draft Law on Organization of Local Government (amended), delegate Nguyen Thi Thuy, Vice Chairwoman of the National Assembly 's Committee on Law and Justice, said that the draft Law this time no longer stipulates the right to question judicial agencies of provincial-level People's Council delegates, which is inappropriate because the decisions of judicial agencies are directly related to citizens' rights, especially disputes and property rights.

From there, the delegates proposed to continue to regulate the right of the provincial People's Council delegates to question the Chief Justice of the provincial People's Court and the Chief Prosecutor of the provincial People's Procuracy to exercise the people's right to supervise judicial activities, ensuring the objectivity and accuracy of judicial decisions.

Also participating in the discussion of this draft Law, delegate Ho Thi Kim Ngan, member of the Provincial Party Committee, Secretary of the Cho Moi District Party Committee, said that the regulations on the authorization mechanism are not really strict and clear, especially in determining the responsibility when the authorized agency, organization or individual performs tasks beyond the scope, time limit or content of the authorization.

Therefore, the delegate proposed to supplement regulations on the responsibilities of the authorizing agency, organization, or individual in monitoring, guiding, inspecting, and evaluating the implementation of the authorized tasks. In case the authorized agency, organization, or individual is found to be not performing properly, the authorizing agency must promptly take measures to prevent it and must still be held responsible.

Regarding the regulations on the structure of People's Council positions, delegate Ho Thi Kim Ngan suggested that the draft Law should stipulate the positions of People's Councils at provincial and communal levels more fully and strictly to ensure that there will be no cases where there will be no full-time representatives to perform the duties of the elected body, reducing the role and quality of activities of the elected body in the organization of the local state apparatus.

Delegates also suggested reviewing and adjusting regulations on the organizational structure of the People's Council to ensure there are enough full-time delegates, thereby enhancing the role, responsibility and effectiveness of elected bodies, and maximizing the role of local authorities and elected bodies in the political system.

Discussing the draft Resolution amending and supplementing the 2013 Constitution, delegate Ho Thi Kim Ngan expressed concerns about the provision of "special cases" allowing the appointment of people who are not People's Council delegates to hold leadership positions of People's Councils at the provincial and communal levels. Therefore, the delegate suggested that it is necessary to specify the "special cases", clearly define the criteria, conditions of application and the scope of leadership positions that can be appointed according to this provision right in the resolution, to facilitate the implementation process.

Discussing the draft Law on Cadres and Civil Servants (amended), paying attention to the regulations on the evaluation of cadres and civil servants, delegate Nguyen Thi Hue, Vice President of the Provincial Women's Union, proposed to add a requirement to increase the responsibility of leaders in implementing policies for cadres and civil servants as well as to be responsible for evaluating cadres in an objective, honest and accurate manner. At the same time, it is recommended to develop a clearer set of criteria that can be quantified; promote the application of digital technology, and apply automatic evaluation software to ensure that cadres and civil servants are evaluated objectively and impartially.

In addition, delegate Nguyen Thi Hue suggested that the draft Law should carefully consider the regulation that when officials and civil servants are assessed as not completing their tasks, they should be assigned to a lower-level job position or forced to resign, to ensure more humanity and understanding. The delegate was concerned that the regulation as in the draft Law would cause waste of human resources, make it difficult to improve work efficiency, and civil servants would not have the opportunity to correct mistakes or overcome limitations; if the regulation is too rigid, it will cause violators to be both under-rated and considered to have been subject to two forms of discipline. Therefore, it is suggested that the assessment should take into account objective factors and ensure more humanity.

Delegates also proposed adding the right of officials and civil servants to participate in training and development to improve their professional qualifications, public ethics and ability to adapt to digital transformation./.
