Maintain the regulation of license exemption for unplanned areas
Delegate Dinh Ngoc Minh said that Article 89 of the current Construction Law allows private constructions in remote areas, where there is no planning, to be exempt from construction permits. This is a provision that has been consistent with practice over the past many years. However, this draft Law narrows the exemption scope, to only level IV constructions and individual houses. This, according to the delegate, "increases the number of subjects requiring permits", causing more procedures for people and small businesses in difficult areas.
“Many small-scale agricultural and forestry processing facilities operate stably thanks to the license exemption. If they are required to obtain a license now, they do not know how to travel and what the costs will be. In fact, for many years, the license exemption has not caused any consequences,” delegate Dinh Ngoc Minh emphasized and proposed to keep the provisions in Article 89 of the current law.
Proposal to exempt all individual houses under 7 floors
The second group of contents was especially emphasized by delegate Dinh Ngoc Minh: Exemption from construction permits for individual houses under 7 floors.
According to the delegate, the current draft law still includes many conditions, so the license exemption is "almost unchanged from the current Law". The delegate proposed a bolder approach: Exempting licenses for all individual houses under 7 floors, regardless of whether they are in urban or rural areas. Assign the Ministry of Construction to issue general regulations and standards. The State only needs to manage the ground level, boundaries, and construction boundaries.
In particular, delegate Dinh Ngoc Minh proposed shifting responsibility to the consulting unit instead of households having to ask for permission: “For projects that are not subject to State licensing, design consultants should be assigned and they must take full responsibility before the law. I do not believe that people want to be licensed, they just want to reduce procedures and costs. Therefore, we should exempt all of them and switch to a mechanism where consultants take responsibility.”
"Untie the knot", reduce trouble for people
The two proposals of delegate Dinh Ngoc Minh both aim at the common goal: Simplifying procedures, reducing social costs, creating convenience for people and businesses; at the same time, still ensuring effective state management.
