
The National Assembly heard a proposal to reduce business licenses for 25 industries and professions.
On the morning of November 11, at the National Assembly, Minister of Finance Nguyen Van Thang said that he would review and cut 25 conditional investment and business sectors that do not meet the criteria and conditions prescribed in the Investment Law, including: Accounting services; Tax procedures; Rice export; Temporary import and re-export of frozen foods...
According to Minister Nguyen Van Thang, the 2020 Investment Law requires 234 industries and occupations to apply for a license to do business, many of which can control output by standards and regulations. Therefore, in this law amendment, the Government will transfer 25 industries and occupations to apply a post-audit mechanism to limit barriers to business entry into the market and promote business freedom.
The Government also plans to abolish the procedure for approving foreign investment policies (authority of the National Assembly and the Prime Minister). Instead, projects with a scale of less than VND20 billion may only need to register foreign exchange transactions with the State Bank to transfer money abroad. Projects with a value of VND20 billion or more (USD760,000) or in sectors or professions with conditional foreign investment must carry out procedures for granting investment registration certificates.
Regarding investment approval, the Government wants to narrow down and clarify the scope of projects that must undergo this procedure. The drafting agency proposed to amend the regulation to only approve investment policies for infrastructure development projects in some important areas such as seaports, airports, telecommunications, or projects that have a major impact on the environment, security, and national defense.
The proposed additional cases that do not need to carry out investment approval procedures include projects to build technical infrastructure for industrial clusters and exploit minerals (excluding offshore projects). In addition, this group also includes projects that request the State to allocate, lease land, or allow households and individuals to change land use purposes.
The Government has proposed to reduce licenses for 25 conditional business sectors and occupations as follows:

Examining this content, Chairman of the Economic and Financial Committee Phan Van Mai proposed that the Government review and substantially reduce investment and business conditions.
According to the review agency, the Government should only retain the conditions that are truly necessary to ensure national defense and security. In addition, the draft law needs to clearly stipulate the conditions for individuals to practice their profession as representatives of legal entities and organizations.
It is known that many opinions at the appraisal agency agree to remove the procedure of approving policies and certificates of overseas investment. However, the appraisal agency also noted that the Government should supplement regulations on notification or registration of investment information (not requiring approval from state management agencies) for cross-checking and post-audit later.
At the same time, the drafting agency needs to coordinate with the State Bank to review and complete relevant regulations on foreign exchange management, ensuring a database interconnection mechanism to allow capital transfers abroad to be made in accordance with registered information.
