Conclusion No. 121-KL/TW dated January 24, 2025 of the 13th Party Central Committee on the Summary of Resolution No. 18-NQ/TW dated October 25, 2017 of the 12th Party Central Committee on a number of issues on continuing to innovate and reorganize the apparatus of the political system to be streamlined and operate effectively and efficiently, stating: “Merge the following ministries: the Ministry of Planning and Investment and the Ministry of Finance into the Ministry of Finance; the Ministry of Construction and the Ministry of Transport into the Ministry of Construction; the Ministry of Agriculture and Rural Development and the Ministry of Natural Resources and Environment into the Ministry of Agriculture and Environment; the Ministry of Information and Communications and the Ministry of Science and Technology into the Ministry of Science and Technology; the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Home Affairs into the Ministry of Home Affairs”.
To specify the conclusions of the 13th Party Central Committee, the Government has issued new decrees stipulating the functions, tasks and organizational structure of the Ministry of Construction, the Ministry of Agriculture and Environment and the Ministry of Science and Technology.
The Ministry of National Defense said that due to the merger of several ministries and changes in functions and tasks, there was a lack of consistency in the current system of legal documents. Therefore, the Ministry of National Defense proposed to develop a draft to perfect the legal basis for implementing electronic border procedures, ensuring consistency and synchronization in the legal system, improving the effectiveness and efficiency of state management, meeting the requirements of administrative procedure reform, applying information technology in the field of immigration control of the Border Guard, facilitating people and vehicles to enter and exit the country, promoting trade, contributing to local socio-economic development.
Draft amendments and supplements to a number of articles of Decision No. 10/2016/QD-TTg dated March 3, 2016 of the Prime Minister on implementing electronic border procedures at seaports as follows:
Amend and supplement Point c, Clause 1, Article 2 on applicable subjects:
"c) Vietnamese ships and boats entering and exiting the country; foreign ships, boats and crew entering, exiting, transiting, and changing ports (including oil and gas exploration, exploitation, and service ships operating offshore; foreign ships permitted to enter or exit the country); Ministry of Construction granting of domestic transport licenses; ships and boats owned by Vietnam flying foreign flags);".
At the same time, amend and supplement Point b, Clause 2, Article 8 on the responsibilities of Ministries, branches; People's Committees of provinces and cities; relevant units, organizations and individuals in implementing electronic border procedures as follows:
"b) Ministry of Science and Technology, Ministry of Construction , Ministry of Health, Ministry of Agriculture and Environment
Within the scope of tasks and powers, it is responsible for directing and guiding specialized state management agencies under its management to coordinate with the Border Guard in implementing electronic border procedures."
Amendment and supplement to Article 19 of Decision No. 15/2019/QD-TTg dated March 28, 2019 of the Prime Minister on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense was amended and supplemented according to Clause 7, Article 1 of Decision No. 03/2025/QD-TTg dated February 12, 2025 of the Prime Minister, as follows:
Amend Article 19 on responsibilities of relevant ministries, branches and provincial People's Committees as follows:
1. The Ministry of Public Security shall coordinate with the Ministry of National Defense to agree on a plan to connect and share data to use electronic identification accounts to log into the electronic border procedure information portal in accordance with the provisions of Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government regulating electronic identification and authentication and the provisions of this Decision.
2. Ministry of Finance
a) Within the scope of tasks and powers, it is responsible for directing and guiding specialized state management agencies under its management to coordinate with the Border Guard in implementing electronic border procedures; coordinate with the Ministry of National Defense to guide relevant enterprises, organizations and individuals to implement electronic border procedures under the national single window mechanism;
b) Direct the implementation of integrating electronic identification accounts on the National Single Window Portal, connecting with specialized systems to perform electronic procedures according to the National Single Window Mechanism.
c) Annually, preside over and coordinate with the Ministry of National Defense to balance and ensure the budget for investment in construction, management and operation of the electronic border procedure information portal in the medium-term public investment plan to ensure the implementation of this Decision. "
