Proposal to establish a Disease Prevention Fund

(Chinhphu.vn) - In the draft Law on Disease Prevention, the Ministry of Health proposed establishing a Disease Prevention Fund.

Ministry of Health proposes to establish Disease Prevention Fund

The draft clearly states that the Disease Prevention Fund is a non-budgetary state financial fund with legal status, its own seal and account, established by the Prime Minister , with its Charter of organization and operation approved.

The Disease Prevention Fund is exempt from paying taxes and other payments to the state budget as prescribed by law.

The Disease Prevention Fund is formed from the following sources: (*)

a) Charter capital provided by the state budget;

b) Annual supplementary state budget according to balancing capacity;

c) Option 1: Take a portion of the special consumption tax revenue from unhealthy products.

Option 2: The mandatory contribution of establishments producing and importing unhealthy products, excluding tobacco, is calculated as a percentage (%) of the price for calculating special consumption tax according to the roadmap: 1.0% from January 1, 2027; 1.5% from January 1, 2028; 2.0% from January 1, 2029. The mandatory contribution is declared and paid together with the special consumption tax by establishments producing and importing unhealthy products, which are self-declared, self-calculated, and self-paid into the Fund's account;

d) Funding sources, voluntary and legal contributions from domestic and foreign enterprises, organizations and individuals;

d) Source from the Fund for Prevention of Tobacco Harms;

e) Other legal sources of income as prescribed by law.

The Government shall specify the details of the above clause (*).

Purpose and operating principles of the Disease Prevention Fund

According to the draft, the purpose of the Disease Prevention Fund is to: Support the resolution of urgent issues that may arise due to pandemics; support proactive disease prevention activities; spend on disease prevention activities that the state budget does not guarantee, does not support, or guarantees, and does not support enough; create resources and ensure sustainable financial resources for disease prevention activities.

Operating principles of the Disease Prevention Fund:

- Not for profit; preserve charter capital and self-cover management costs. Perform revenue, expenditure, settlement, financial disclosure, assets and accounting work in accordance with the law.

- Subject to inspection, examination and audit by the state financial management agency and state audit of the financial activities of the Disease Prevention Fund, supervision by the Vietnam Fatherland Front and the community.

- Ensure publicity, transparency, thrift, efficiency, proper use and compliance with legal regulations.

- The previous year's remaining budget balance of the Disease Prevention Fund is carried over to the following year for continued use.

The draft clearly states that the Government regulates the management and use of the Disease Prevention Fund.
