Regulations on communes, wards and special zones meeting legal access standards
The draft clearly states that the assessment and recognition of communes meeting legal access standards aims to assess the level of task completion of commune-level authorities in the work of building and organizing law enforcement; promptly assess the practical situation and have solutions to overcome limitations and shortcomings, improve the effectiveness of commune-level authorities; raise awareness of understanding and complying with the law among people and businesses, contributing to building a culture of law compliance.
3 criteria for legal access
The draft stipulates criteria for assessing and recognizing communes that meet legal access standards, including:
Criterion 1: Issue legal documents within authority in accordance with legal regulations on issuance of legal documents.
Criterion 2: Carry out legal dissemination andeducation in accordance with legal regulations on legal dissemination and education.
Criterion 3: Conduct mediation work at the grassroots level in accordance with legal regulations on mediation at the grassroots level.
The Provincial People's Committee shall specify in detail the content, level of achievement, and documents for assessing the above criteria.
Time and authority to recognize commune level as meeting legal access standards
The assessment and recognition of communes meeting legal access standards is carried out annually for communes registering for recognition. The provincial People's Committee decides the time to organize the annual assessment and recognition of communes meeting legal access standards.
The Chairman of the Provincial People's Committee decides to recognize communes as meeting legal access standards.
Procedures for assessment, recognition and announcement of communes meeting legal access standards
1. The People's Committee at the commune level shall register for recognition of meeting legal access standards with the People's Committee at the provincial level.
2. The People's Committee at the commune level organizes meetings to assess the implementation results and the level of achievement of each criterion for legal access; publicly posts the self-assessment results; and sends the application for recognition of the commune level as meeting legal access standards to the Department of Justice.
3. The Department of Justice shall organize the appraisal, prepare a report on the appraisal results of the dossiers and the level of legal access standards of each commune-level unit and submit it to the Chairman of the Provincial People's Committee for consideration and decision to recognize the commune level as meeting legal access standards.
4. The application for recognition of commune level meeting legal access standards includes:
a) Document requesting recognition of commune level meeting legal access standards;
b) Self-assessment of the level of achievement of each criterion;
c) Summary, acceptance and explanation of opinions of agencies, organizations and individuals on self-assessment results and scoring of criteria (if any);
d) Other relevant documents (if any).
5. No later than 30 days from the date of recognition of communes meeting legal access standards, the Chairman of the Provincial People's Committee shall announce the list of communes meeting legal access standards and make it public on the Provincial Electronic Information Portal.
