Dien Bien: Fine of 30 million VND for a landowner for administrative violations in the land sector

Specifically, in Decision No. 04/QD-XPHC, dated April 14, 2025, the People's Committee of Dien Bien Phu city decided to impose an administrative fine of VND 30 million on Mr. Nguyen Huu Phuc, residing at Group 9, Thanh Truong Ward, Dien Bien Phu City (land owner) for the act of "Administrative violation in the field of land".

Previously, in 2021, Mr. Nguyen Huu Phuc poured soil on an area of 2,545m ² (land specialized in rice cultivation). Then, in March 2025, Mr. Phuc poured concrete on the rice-growing land (previously filled with soil) with an area of 1,089m ² , built 72 huts with bamboo poles, bamboo frames covered with canvas roofs; built a house with an iron frame and corrugated iron roof with an area of 15m ² , surrounded by blue corrugated iron, roofed with corrugated iron; poured crushed stone on 1,456m ² .

Right after Mr. Phuc finished building the shed, the iron-frame house with the corrugated iron roof (mid-March 2025), hundreds of households gathered to trade, forming a spontaneous market right next to Highway 12. The spontaneous market was held from early morning to late at night, with thousands of people coming in and out of the market every day, posing a potential danger to people and vehicles moving in the area. This situation caused outrage among local people.

In addition to the main penalty (a fine of 30 million VND) imposed on Mr. Nguyen Huu Phuc, the People's Committee of Dien Bien Phu City also forced Mr. Nguyen Huu Phuc to take remedial measures to restore the original state of the land before the violation within 30 days (from the date of receiving the decision). That is, forcing Mr. Nguyen Huu Phuc to demolish the construction (iron-frame house with corrugated iron roof, temporary shed), relocate assets on the land and renovate and restore the original state of the land plot to ensure that the land is used for the right purpose according to the issued certificate (rice land).

In case Mr. Nguyen Huu Phuc fails to restore the original status of the land within the time limit as per the decision, the People's Committee of Dien Bien Phu city will carry out enforcement in accordance with the provisions of law.
