On September 22, 2023, the Prime Minister issued Decision No. 24/2023/QD-TTg stipulating the conditions for determining people exposed to HIV, people infected with HIV due to occupational accidents. Accordingly, people identified as exposed to HIV due to occupational accidents must meet the following conditions while performing their duties: having one of the following accidents: blood, blood products or body fluids of an HIV-infected person coming into direct contact with a mucous membrane or damaged skin area, blood, blood products or body fluids of a person whose HIV infection status is unknown coming into direct contact with a mucous membrane or damaged skin area.

Have a negative HIV test result performed by a testing facility in accordance with the provisions of the law on medical examination and treatment. Blood samples used for HIV testing must be taken from people who have occupational accidents within 72 hours from the time of the accident. Regarding the conditions for determining people infected with HIV due to occupational accidents, people determined to be infected with HIV due to occupational accidents must meet the conditions such as being exposed to HIV due to occupational accidents, having a positive HIV test result performed by an HIV testing facility qualified to confirm HIV positivity. Blood samples used for testing must be taken from people exposed to HIV at a time from 30 days to 180 days before the time of the occupational accident.

Regarding the authority to issue certificates of exposure to HIV, HIV infection due to occupational accidents, the Ministry of Health issues certificates of exposure to HIV, HIV infection due to occupational accidents to subjects under its management authority, while the Ministry of National Defense issues certificates of exposure to HIV, HIV infection due to occupational accidents to subjects under its management authority. The Ministry of Public Security issues certificates of exposure to HIV, HIV infection due to occupational accidents to subjects under its management authority. The Department of Health of provinces and centrally run cities issues certificates of exposure to HIV, HIV infection due to occupational accidents to subjects under its management authority and subjects under the management authority of other ministries and branches, except in prescribed cases.

Regarding procedures, agencies, organizations, and units managing people exposed to HIV or infected with HIV due to occupational accidents shall send 01 set of documents to the competent authority to issue the prescribed certificate. In case the documents are valid, within 05 working days from the date of receiving the complete documents, the competent authority shall issue a certificate of exposure to HIV or infected with HIV due to occupational accidents. The certificate of exposure to HIV or infected with HIV due to occupational accidents shall be issued according to regulations. In case the documents are invalid, within 02 working days from the date of receiving the documents, the competent authority shall issue a written notice stating the reasons and instructions for the management agency to supplement the documents.
