This viewpoint was expressed by Vice Chairman of the Committee for Culture and Society Ta Van Ha when discussing the Resolution on a number of special mechanisms and policies for private economic development at the meeting hall on the morning of May 16.

According to delegate Ta Van Ha, Vietnamese private enterprises are currently facing many bottlenecks that must be removed in order to develop.

“Resolution 68 of the Politburo on private economic development is not only a breakthrough but also creates a driving force to promote the release of internal resources, promoting the country's economic development in the new era. Therefore, I expect this resolution to be like a wind blowing the kite of the private economic sector to fly far,” said Mr. Ha.

However, delegate Ha said that there are provisions that do not need to be included in the draft resolution because they are already provided for by law. For example, ensuring the principle of presumption of innocence is clearly stated in the Constitution.

“This is not a special mechanism for private enterprises. Therefore, it is necessary to add support content on trade policy and international integration, because currently it is very difficult for enterprises to bring products to compete in the international market as well as support in terms of justice, and every time there is a trade dispute with a foreign country, Vietnam always suffers a loss.

Businesses also need policy stability. Many new businesses are having a hard time starting up, but policies are constantly changing. What businesses fear the most is that while they are focusing on investing, policies will change and they will have to go back to the starting point," said delegate Ha.

Delegate Tran Hoang Ngan (HCMC) also highly appreciated the efforts of the National Assembly Standing Committee and the Government to promptly institutionalize the Party's policy and Resolution 68 of the Politburo on private economic development.

"This resolution is of particular importance as the country is accelerating its development into a new era. The private economic sector accounts for 51% of GDP and contributes 33% of the total state budget revenue, so it needs many special support mechanisms to promote its role as the most important driving force by 2030," Mr. Ngan emphasized.

The draft resolution sets a target of 2 million businesses by 2030. Mr. Ngan said that to achieve this target, there must be special solutions. According to him, currently, only about 30,000 - 40,000 businesses increase each year, so in order to reach 2 million businesses in 5 years, there must be policies to support individual business households to become businesses.

Along with that, according to the delegate, it is necessary to improve and expand larger-scale enterprises.

The draft resolution clearly states the distinction between legal and personal liability, criminal and civil and administrative liability. Mr. Ngan suggested that the Government review relevant laws such as the Penal Code and the Civil Code to legalize the above orientation, because these are important contents that the business community is very interested in.

Commenting on the policy to support access to land and production and business premises, Mr. Ngan proposed adding content that localities with land, potential and strengths should create a mechanism to establish industrial parks for private enterprises and small and medium enterprises to rent with support policies.

"If we want economic independence, the private sector must grow, so we need provisions to encourage localities to create clean land for the private economic sector," Mr. Ngan emphasized.

Strengthening the application of bail and release measures

Delegate Ha Sy Dong (Quang Tri delegation) said he agreed with the principles of inspection, examination, and licensing stipulated in the draft.

However, he proposed to increase the application of bail and release measures in criminal proceedings. “ Only in cases of real necessity should temporary detention and temporary detention be applied, ” Mr. Dong emphasized, adding that in reality, in many cases, if businessmen were released on bail, they would have the opportunity to recover damages or continue to operate their businesses.

" The prolonged detention of businessmen sometimes only resolves a small case but causes a large enterprise to fall into difficulty and lose its international competitiveness, " added Mr. Ha Sy Dong.

Regarding bankruptcy and dispute resolution, the Quang Tri delegation agreed with the draft regulation on bankruptcy resolution under simplified procedures and proposed to expand (or add one more article) on resolving commercial business disputes.

According to him, resolving commercial business disputes is a bottleneck for many private businesses that want to develop.

Mr. Ha Sy Dong also commented on some specific contents, such as the need to ensure compliance with procedural time limits when accepting, trying and enforcing judgments on commercial business cases.

Delays and prolongation of the time to handle cases and prolongation of the time to execute commercial business judgments are criteria for disciplining officials ,” he said, adding that this is a very pressing issue for businesses because the time to handle commercial business cases is too long.

Regarding the settlement of complaints and administrative cases, the delegate assessed that a major problem today is that businesses rarely dare to sue state agencies when they make mistakes. According to him, this not only causes businesses to suffer losses but also seriously and persistently violates state discipline.

The reason for this situation is partly because businesses fear being persecuted, but partly because they know that even if they sue, they will lose.

I don’t have specific numbers, but according to many legal experts, cases where businesses sue the government and win are extremely rare. Part of the reason is that provincial and district courts try the provincial and district chairmen of the same province and district, ” said Mr. Ha Sy Dong, who said that this does not ensure objective independence.

I propose to study and supplement regulations on administrative proceedings, allowing businesses to sue administrative acts and administrative decisions of provincial and district authorities in courts elsewhere, ” Mr. Dong said, and proposed that in the immediate future, lawsuits could be allowed in the plaintiff’s province or a neighboring province.
