Comprehensive innovation in legal support for small and medium enterprises

(Chinhphu.vn) - In the context that the Party and State are promoting institutional improvement and innovating thinking in building and enforcing laws, legal support for small and medium-sized enterprises is increasingly valued. Comprehensive innovation of this activity is considered an important solution to help enterprises develop sustainably, improve competitiveness and integrate deeply.

It is necessary to innovate thinking and working methods.

In recent times, the Party and the State have issued many important new documents, demonstrating special attention to perfecting institutions, organizing law enforcement and developing the private economic sector - one of the driving forces of the economy. In particular, legal support for businesses, especially small and medium enterprises (SMEs), is identified as a key content.

Implementing Resolution No. 41-NQ/TW of the Politburo , the Government's Action Program issued with Resolution No. 66/NQ-CP sets out one of the goals to strive for by 2030: our country will have at least 2 million enterprises, including the formation and development of many entrepreneurs, leaders of strong economic groups with potential and competitiveness in the domestic and international markets...

To achieve this goal, the Government assigned ministries, branches and localities to deploy 7 groups of tasks, in which the Ministry of Justice was assigned to preside over and coordinate with relevant agencies to promote and innovate legal support for businesses, and study and amend Decree No. 55/2019/ND-CP to comprehensively innovate legal support for SMEs.

In particular, the promulgation of Resolution No. 66-NQ/TW and Resolution No. 68-NQ/TW of the Politburo has required strong innovation in thinking and awareness in building and organizing law enforcement. These resolutions emphasize the need to promptly identify and remove "bottlenecks" from legal regulations, pave the way for development, and mobilize the active participation of people and businesses in the process of socio-economic creation.

Along with that, the State also advocates building special mechanisms and policies to support SMEs according to market principles and international commitments; prioritizing resources for the private economic sector, especially in legal support, trade dispute resolution and international integration.

The strong direction of the Party and State, together with specific action programs of the National Assembly and the Government, have created a solid political and legal foundation for innovation in thinking and improving the effectiveness of legal support work as an indispensable component in the sustainable development process of SMEs.

Diversify forms of legal support

To improve the effectiveness of legal support for SMEs, the Ministry of Justice will implement legal support for businesses in a practical, flexible and responsive manner. Activities will be linked to the policies of the Party and State, closely following practical life, and enhancing the application of digital transformation and artificial intelligence (AI) to optimize efficiency.

The Ministry of Justice is also researching and building a legal support model suitable for each type of enterprise and industry, with priority mechanisms for business households, enterprises in remote areas, women-owned enterprises, or enterprises creating social impact.

Regarding institutions, the immediate focus is to amend and supplement Decree No. 55/2019/ND-CP, in order to overcome the shortcomings and limitations that have been revealed after 5 years of implementation. Accordingly, focusing on perfecting the institutions according to a number of regulations to expand the subjects of legal support for enterprises not only SMEs, it is necessary to add beneficiaries to business households to be consistent with the Party's policies, the State's policies and the needs of society; have a general mechanism for legal support for enterprises and a priority mechanism, specific to each type of subject that needs to be prioritized according to the Party's Resolutions.

At the same time, it is necessary to clarify the responsibilities of ministries, branches, localities and business representative organizations in resolving legal difficulties and problems for businesses. An important direction is to increase the cost of legal consultancy support, ensuring consistency with other business support policies.

The Ministry of Justice is also studying specific regulations on the model and operation of the Business Legal Support Center, in order to remove legal difficulties and obstacles, and resolve domestic and foreign disputes. Timely issue regulations to adjust the operation of the National Legal Portal in the direction of being a unified focal point in accessing the law for people and businesses; supported by the state budget; the Ministry of Justice is the state management agency for this Portal.

Research and develop regulations on providing free legal consulting services for small and micro enterprises, business households, and individual businesses as prescribed in Article 13, Resolution No. 198/2025/QH15 dated May 17, 2025 of the National Assembly on a number of special mechanisms and policies for private economic development.

Along with institutional improvement, the Ministry of Justice also identified the key task of strengthening state management of legal support for SMEs, regularly providing guidance, answering questions, and resolving problems related to the specific needs of businesses. Inspection, evaluation, interim and final review work will be promoted, thereby forming a set of criteria for evaluating the effectiveness of legal support for SMEs.

In addition, it is necessary to diversify forms of legal support, through communication programs, seminars, dialogues, online legal advice, etc. The application of digital technology and artificial intelligence will help improve efficiency, reduce costs, and expand businesses' access to law nationwide.

In addition, the team of legal consultants and officers performing legal support work will be strengthened and trained intensively to meet new requirements. This is the decisive factor in the quality of legal services, helping businesses feel secure in production and business in a transparent and stable legal environment...
