Implementing the working program, on the morning of August 23, comrade Le Thi Thuy, member of the Party Central Committee, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council chaired the regular citizen reception meeting in August 2023.

At the conference, citizen Hoang Dinh Lung, Van Boi village, Nhat Tuu commune (Kim Bang) requested the competent authority to consider granting a Land Use Rights Certificate (LURC) for the land plot his family is using along the Nhue River dike, Nhat Tuu commune; in 1998, his family paid VND 6,474,000 to the People's Committee of Nhat Tuu commune to be granted 485 square meters.

Specifically, the land origin, land use process and current status of the land plot are as follows: According to the current status map of Nhat Tuu commune measured in 2020 and the cadastral map of Nhat Tuu residential area established over the periods, land plot No. 19, map sheet PL09 has a total area of 952m2, which is pond land managed by Nhat Tuu Commune People's Committee. The land location that Mr. Hoang Dinh Lung is requesting to be granted a Land Use Rights Certificate belongs to part of land plot No. 19, map sheet PL09. In 1996, Nhat Tuu Commune People's Committee contracted Mr. Hoang Dinh Lung's household and a number of households in Van Boi village to build a fish pond.

In 1998, the land that was being contracted out was sold to households (including Mr. Hoang Dinh Lung's household) and the one-time profit from the pond area was collected to pay into the state budget. Mr. Hoang Dinh Lung's household paid 6,474,000 VND to be assigned 1.66 sao (equivalent to 598m2) in part of plot number 19, map sheet PL 09, Nhat Tuu commune.
During the land use process, Mr. Hoang Dinh Lung's household transferred 113m2 to Mr. Hoang Dinh Gia (Mr. Lung's cousin). Thus, the actual area that Mr. Lung's household is using is 485m2. During the land use process, Mr. Lung's household did not have any disputes with neighboring households. In the current state of the land plot, Mr. Hoang Dinh Lung's household has built a level 4 house (about 70m2) and some other structures on the land to serve livestock farming.

In November 2019, the delegation of the Provincial People's Council visited voters in Van Boi village, Nhat Tuu commune. Through the meeting, 33 households bordering the A3-2-1 drainage canal on the field side of Nhat Tuu village, Van Boi village (including Mr. Hoang Dinh Lung's household) petitioned that the People's Committee of Nhat Tuu commune had allocated land to households since 1998, the households had fulfilled their financial obligations but had not yet been granted Land Use Rights Certificates. The People's Committee of Kim Bang district established a working group to verify, collect documents, measure the current land use status and propose solutions to the petitions of the 33 households.

In 2020, Nhat Tuu Commune People's Committee developed a plan to measure the current land use status of 33 households as a basis for requesting Kim Bang District People's Committee to issue Land Use Right Certificates. According to the plan made public by Nhat Tuu Commune People's Committee, the entire land area that Nhat Tuu Commune People's Committee sold and collected money from households that were requested to be issued Agricultural Land Use Right Certificates. After the plan was made public, households that paid money to Nhat Tuu Commune People's Committee did not agree (including Mr. Hoang Dinh Lung's household) because the amount of money that households paid with an average unit price of about 10,258 VND/m2 was equivalent to the price of residential land in Nhat Tuu Commune in 1998.

At the conference, after listening to the commune and district authorities explain and clarify a number of issues related to Mr. Lung's land plot and the opinions of the relevant agencies, Secretary of the Provincial Party Committee Le Thi Thuy concluded: Mr. Lung is eligible for a Land Use Rights Certificate according to the provisions of law because of the stable land use process and stable land use status.

However, according to current legal regulations, the allocation of residential land to households according to regulations, each household is not granted more than 200m2 of residential land, therefore, the People's Committee of Kim Bang district is assigned to coordinate with relevant agencies to complete legal procedures to issue a Land Use Right Certificate to Mr. Lung's household for 200m2 of residential land, the remaining land is issued with a Land Use Right Certificate to agricultural land according to the prescribed norms, the completion time is no later than December 31, 2023.

To issue the Land Use Right Certificate to Mr. Lung's household, the People's Committee of Kim Bang district and Nhat Tuu commune is requested to conduct an inspection and review of the exact area, current status, and time of land use of Mr. Lung to determine financial obligations. During the process of waiting for the issuance of the Land Use Right Certificate, citizens are requested to comply with the regulations, not to file complaints, affecting the political security situation, social order and safety in the area.

The Provincial Party Secretary assigned the Party Committee of the People's Committee to direct the Provincial People's Committee to direct Kim Bang district to review similar cases and advise competent authorities to resolve them in accordance with the law. The Fatherland Front and mass organizations continue to promote propaganda to the people. The Provincial Party Committee's Internal Affairs Committee continues to monitor the progress of the resolution and report to the Provincial Party Committee Standing Committee for consideration and resolution./.
