If there is a 1/500 planning, then a building permit is exempted.
Recently, at the Government's special meeting on law-making in May, Prime Minister Pham Minh Chinh directed to resolutely cut unnecessary procedures, including construction licensing procedures.
According to Prime Minister Pham Minh Chinh, the people have the right to use the land, so they have the right to build. Not only that, the land has been planned in detail regarding height, green ratio, construction density, distance between houses, and distance from the sidewalk. All of these are regulated, so there is no need to apply for a building permit. The People's Committee of the commune or ward must go and check whether the people are building correctly.
Then, on May 29, Prime Minister Pham Minh Chinh signed Official Dispatch No. 78/CD-TTg sent to the Minister of Construction and Chairmen of People's Committees of provinces and centrally run cities to focus on cutting and simplifying administrative procedures (AP) in the construction sector.
In the telegram, Prime Minister Pham Minh Chinh emphasized that recently, the Government and the Prime Minister have issued many resolutions and directives with drastic, timely and effective directions on administrative procedure reform. However, according to the feedback from people and businesses, the implementation time of some construction investment projects is still prolonged, with many administrative procedures, and the cost of complying with administrative procedures is still high.
In order to reform administrative procedures in the construction sector more strongly, substantially and drastically, to meet the requirements and directions of the Politburo, the Secretariat and the Government, the Prime Minister requested the Minister of Construction and the Chairmen of the People's Committees of provinces and centrally run cities to continue to carry out assigned tasks and solutions, focusing on implementing a number of specific tasks as follows: urgently review, cut and simplify 361 administrative procedures related to production and business activities, 447 business conditions under the management of the Ministry of Construction, ensuring a reduction of at least 30% of the time to handle administrative procedures, 30% of the cost of complying with administrative procedures, and 30% of business conditions in 2025, with attention paid to focusing on researching, reviewing, cutting and strongly simplifying administrative procedures in the construction sector.
According to Chairman of the Khuong Provincial Architects Association Nguyen Duc Chuong, the policy of abolishing construction permits, including cases applied to individual houses, is reasonable.
"If there is an approved 1/500 detailed plan, then exempting construction permits is reasonable and appropriate," Mr. Chuong shared.
According to the Construction Law, construction licensing activities are carried out for housing construction projects in urban areas, real estate investment projects, and large-scale housing; while construction licensing has not been carried out in rural areas.
In urban areas, construction permits are issued for two groups of projects: real estate projects, commercial housing, high-rise buildings, high-rise apartments, factories in industrial parks and individual housing projects for urban residents.
Research conducted in Bien Hoa city and Long Khanh city

Implementing the direction of the Prime Minister, the Provincial People's Committee has assigned the Department of Construction to conduct a pilot study of locations that can be exempted from construction permits.
"Bien Hoa City and Long Khanh City will be the places that will be studied for pilot application first" - Vice Chairman of the Provincial People's Committee Ho Van Ha said.
According to Vice Chairman of the Provincial People's Committee Ho Van Ha, in addition to Bien Hoa City and Long Khanh City, the Provincial People's Committee also assigned the Department of Construction to study some areas that have been approved for detailed planning at a scale of 1/500, such as urban areas, to exempt construction permits. At the same time, study more areas where resettlement construction projects have been approved for detailed planning.
“These areas will also be studied and considered for exemption from construction permits. People only need to comply with the approved 1/500 detailed planning,” added Vice Chairman of the Provincial People’s Committee Ho Van Ha.
