Dong Nai is speeding up the process of relocating enterprises out of industrial parks (IPs) according to the policy approved by the Government. This is an unprecedented move for IPs across the country.

Therefore, the process, procedures, especially appropriate and legally compliant compensation and support policies are issues of concern to both businesses and the government.

Still confused and stuck in implementation

Bien Hoa 1 Industrial Park has the longest history in the country, located in a prime location for transportation and next to the Dong Nai River. In order to develop the province's first-class urban area in accordance with the approved planning, while minimizing negative impacts on the environment, in February 2024, the Provincial People's Committee approved the Project to Convert the function of Bien Hoa 1 Industrial Park into an urban - commercial - service area and improve the environment.

Director of the Provincial Land Fund Development Center Mai Phong Phu shared that through meetings, dialogues and practical work, most enterprises agree and support the province's policy. However, this industrial park was formed before 1975, so determining the origin of the land, the time of creation of assets on the land and valuing assets as a basis for compensation and support when land is recovered is facing difficulties.

Bien Hoa 1 Industrial Park has a total area of ​​over 330 hectares. At the time the province approved the project to convert its functions, there were 76 enterprises leasing land and infrastructure; the total number of employees working in the enterprises was nearly 21,500 people.

Regarding property compensation, according to the Director of the Provincial Land Fund Development Center, the 2024 Land Law and guiding decrees specifically stipulate: for housing of households and individuals, when the State reclaims land, compensation will be made according to the new construction value, and the remaining property after compensation will be handled. However, for enterprises, current laws have not clearly stipulated in which cases compensation is applied according to the new construction value and in which cases compensation is made according to actual damage; it has not been clarified whether the property that has been compensated by the State can be continued to be used by enterprises or become public property. "This is an important basis for developing compensation plans for enterprises," Mr. Phu emphasized.

The second problem is related to enterprises that have been administratively sanctioned (currently more than 30 establishments) in the environmental field. In addition to being fined and having their operations suspended for a period of time, these enterprises are also forced to relocate from Bien Hoa 1 Industrial Park. The decisions on handling administrative violations of the Provincial People's Committee clearly state that enterprises must dismantle and relocate their factories, constructions, machinery, production lines and bear all related costs. Therefore, the Provincial Land Fund Development Center is wondering whether the above-sanctioned enterprises will be compensated for their factories, constructions and costs of dismantling, relocating, and reinstalling equipment according to the provisions of the 2024 Land Law.

Another content that is of special interest is the policy to support stable life and employment for workers working at enterprises that have to relocate.

To accelerate the process of converting the functions of Bien Hoa 1 Industrial Park, on May 12, 2025, the Provincial Party Standing Committee issued Decision No. 2241-QD/TU to establish a Steering Committee for the relocation, compensation and site clearance of Bien Hoa 1 Industrial Park, headed by Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Council Thai Bao. On the same day, the Provincial People's Committee issued Decision No. 1543/QD-UBND to establish a Special Working Group to support the relocation of Bien Hoa 1 Industrial Park, headed by Deputy Director of the Department of Construction Huynh Tan Loc.

Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Council Thai Bao affirmed that the conversion of the function of Bien Hoa 1 Industrial Park is an important and urgent political task. Before August 1, at least 90% of the land on the total area of ​​180 hectares in the priority area must be cleared to start the project to build the office building, have clean land to organize auctions, and must not be delayed.

Vice Chairman of the Provincial People's Committee Ho Van Ha said that the province is making great efforts to realize the Project of Converting the Function of Bien Hoa 1 Industrial Park with the aim of achieving three main goals: developing Bien Hoa urban area in accordance with the planning; changing the appearance and urban architecture associated with the natural landscape; improving land use efficiency. When completed, this area will form two functional areas: the provincial political-administrative center and the urban-commercial-service area. In particular, the provincial political-administrative center is an urgent item when merging provinces.

Regarding this content, Deputy Head of the Provincial National Assembly Delegation Bui Xuan Thong said that the delegation is very interested in and supports the Project to Convert the Function of Bien Hoa 1 Industrial Park of the province. Through meetings with voters, it shows that both people and businesses highly agree with this policy.

"The relocation of the industrial park with a long history, located next to the Dong Nai River, is completely correct" - Mr. Bui Xuan Thong expressed.

Regarding the contents of the law that are not clearly and specifically regulated such as: compensation for factory buildings on recovered land, handling of enterprise assets after compensation, supporting costs for enterprises that are penalized and forced to relocate..., the National Assembly Delegation of the province will study, synthesize and make recommendations to the central ministries and branches to resolve the issues for the province.

In the coming time, to ensure the implementation of the Project on Conversion of the Function of Bien Hoa 1 Industrial Park of the province in accordance with legal regulations, the National Assembly Delegation of the province will include this content in the project supervision program. The purpose is that if any policy inadequacies are detected, recommendations will be made to competent authorities for amendments and supplements; limitations will be identified and proposed to relevant agencies for correction.
