This morning, the National Assembly discussed in the hall the draft resolution on the mechanism for handling difficulties and problems caused by legal regulations.
In his explanatory speech, Minister of Justice Nguyen Hai Ninh further clarified the scope of the draft, including accepting the opinions of delegates on the exclusion of elements related to the constitution, basic rights of citizens, judicial proceedings, national security and defense, and criminal matters.
Some delegates proposed considering expanding this mechanism to apply to legal documents issued by localities.

Regarding this content, Mr. Nguyen Hai Ninh said that the scope and nature of the regulation are different, when the goal of the National Assembly's resolution is specific so that the Government can review conflicting and overlapping contents during the application process or created by the document itself.
The Minister of Justice said that if local documents have conflicts or overlaps, the handling is entirely up to the issuing entities. At the same time, according to him, this authority has been stipulated in the Law on Promulgation of Legal Documents.
“Difficult and complicated issues related to laws and resolutions of the National Assembly and the National Assembly Standing Committee must be given top priority. As for issues that are not really urgent and are included in the annual law and ordinance making program or in the term program, priority must be given to handling according to the programs approved by the National Assembly,” he emphasized.

Regarding the proposal of the delegate to assign the Government to provide detailed guidance on exemption of responsibility in implementation, Minister Nguyen Hai Ninh said that up to now, there has been no legal document specifically regulating this matter.
Instead, when dealing with complex and urgent issues, there is a principle of exemption from liability for cases where the person performing the task does not seek personal gain. This contains a lot of content, ensuring publicity, transparency, responsibility and clarity in participating in the handling.
"Although there is a mechanism, those who directly handle complex and urgent issues or participate in appraisals are still very worried," Mr. Ninh stated, adding that just because there is a resolution, it cannot be abused.
Mr. Ninh also emphasized the importance of the monitoring mechanism. The draft will specify more clearly the composition, monitoring and inspection mechanisms of the subjects regarding the implementation of the resolution.
“Not only government agencies but also the Nationalities Council , committees of the National Assembly, the Vietnam Fatherland Front and representatives of the Central Steering Committee participate in this work,” said the Minister of Justice.

Further clarifying, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the delegates highly agreed on the need to immediately pass the resolution.
Regarding the name, according to Mr. Dinh, it can be said that this is a "special mechanism to resolve conflicts and problems in the legal system" or "urgent solution".
"This Resolution institutionalizes Resolution 66 on innovation in law-making and enforcement. The Central Steering Committee on innovation in institution-building, headed by the General Secretary, has more than half of the Politburo members participating.
“Handling legal issues is an urgent, important and complicated task. If not resolved promptly, it will lead to congestion and hinder the country’s socio-economic development. Therefore, this is a task that needs to be done immediately and resolutely, and thoroughly,” said Mr. Dinh.
