Is seniority allowance for teachers still included in the Draft Law on Teachers?

According to Article 43 of the latest Draft Law on Teachers, teachers at public educational institutions are entitled to salaries and allowances as follows:

Teachers' salaries according to the salary scale are ranked highest in the administrative career salary scale system;

Seniority allowance;

The highest vocational allowance in the industries and fields that enjoy vocational allowance;

Other allowances as prescribed by law.

Teachers working in sectors and fields with special policies are entitled to special policies according to regulations and are only entitled to the highest level if that policy coincides with the policy for teachers.

The Government details the contents related to salaries and allowances for teachers .

Thus, in the latest Draft Law on Teachers, teachers are still entitled to seniority allowance.

Seniority allowance for teachers is one of the allowance regimes used to calculate teachers' benefits, helping teachers to be more committed to their profession.

After a period of uproar over the removal of seniority allowances, many teachers were happy when their salaries were not reduced but instead increased by 30% of the basic salary (currently 2,340,000 VND, effective from July 1, 2024).

Who is eligible for seniority allowance for teachers?

According to Article 2 of Decree 77/2021/ND-CP , the seniority allowance regime for teachers is applied to teachers who are teaching and educating in public educational institutions and academies, schools, and training and fostering centers under state agencies, political organizations, and socio-political organizations (collectively referred to as public educational institutions) that have been transferred and classified according to Decree 204/2004/ND-CP , including:

Teachers include officials in the education and training sector (with code starting with V.07) and officials in the vocational education sector (with code starting with V.09) on the payroll approved by competent authorities, currently teaching and educating in public educational institutions funded by the State (including revenue from the state budget and other revenue sources as prescribed by law).

Teachers on the payroll approved by competent authorities, currently teaching, instructing practice and experiments at training ships, school workshops, stations, camps, practice centers, laboratories, and subject rooms of general education institutions, continuing education institutions, vocational education institutions, and public universities.

Subjects not subject to the above regulations but holding codes with the first characters V.07 and V.09 are not eligible for seniority allowance for teachers.

Latest seniority allowance for teachers 2024

The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, teachers participating in teaching and education and paying compulsory social insurance for 5 years (60 months) are entitled to a seniority allowance equal to 5% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if any). From the 6th year onwards, each year (12 months) is calculated with an additional 1%.

Seniority allowance is paid with the monthly salary and is used to calculate social insurance, health insurance, and unemployment insurance contributions and benefits.
