As someone working in the food production and trading sector, Mr. Nguyen Nhu So – Chairman of the Board of Directors of DABACO Vietnam Group – said that the fake milk incident is not just an isolated incident but clearly reflects “systemic loopholes” in the design of current policies and law enforcement.
“The case of nearly 600 types of fake milk powder circulating publicly over the past four years has exposed laxity in product quality control, and at the same time demonstrated the ineffectiveness of the coordination mechanism between state management agencies,” the delegate said, emphasizing that assigning responsibility in this case is very vague, because “everyone is involved but no one is the final point of responsibility.”
According to him, the fragmentation and overlapping of responsibilities between the Ministry of Health, the Ministry of Industry and Trade and local authorities has resulted in no agency taking full responsibility. This leads to shirking and avoiding responsibility when serious consequences occur, and makes it difficult to thoroughly handle violations.
Delegate Nguyen Nhu So suggested that it is necessary to clearly establish the leading role and specify the agency responsible for controlling the quality of goods and products; at the same time, build an effective inter-sectoral coordination mechanism to avoid management gaps or overlapping functions.
“The post-audit mechanism is the right direction, in line with international practices and the policy of administrative procedure reform. However, if there is a lack of capacity, connectivity and strong enough sanctions, post-audit will become a loophole for exploitation and avoidance of responsibility,” he analyzed.
From this reality, delegates proposed that the draft law needs to fundamentally resolve the problem by establishing a clear management model, with specific responsibilities, strict sanctions and regulations for close coordination between functional agencies.
Previously, on April 15, the Ministry of Public Security prosecuted and temporarily detained 8 suspects in a ring producing and trading fake milk powder for people with diabetes, kidney failure, premature babies and pregnant women. According to the investigation, this ring produced and sold 573 types of fake milk powder over the course of 4 years, illegally earning nearly 500 billion VND.
