Teachers at public schools are not allowed to manage or operate extra teaching outside of school.
In Clause 1, Article 2 of Circular No. 29/2024/TT-BGDĐ dated December 30, 2024 of the Ministry of Education and Training regulating extra teaching and learning (referred to as Circular 29), it is defined: "Extra teaching and learning are additional teaching and learning activities in addition to the time prescribed in the education plan for subjects and educational activities (hereinafter referred to as subjects) in the general education program, the continuing education program at the junior high school level, the continuing education program at the high school level issued by the Minister of Education and Training".

Point a. Article 6 of Circular 29 states that organizations or individuals organizing extra-curricular teaching and learning activities outside of school with fees from students (referred to as extra-curricular teaching establishments) must comply with the requirements for business registration according to the provisions of law . Therefore, many people misunderstand that from now on, teachers who want to organize extra-curricular teaching and learning activities outside of school with fees, for example, organizing small groups to teach 5-7 students, 10-20 students, only need to register for business and teach. However, it is necessary to make a clear distinction.
Which teachers are allowed to register for private tutoring business?
Article 4 of Circular 29 clearly states the cases in which extra teaching and extra teaching are not allowed:
- "Do not organize extra classes for primary school students , except in the following cases: art training, physical education, and life skills training.
- Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned to teach by the school according to the school's educational plan.
- Teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching outside of school.
Thus, teachers in public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching. However, if teachers participate in extra-curricular teaching, they need to carry out other procedures (must report to the principal about the subject, location, form, and time of participation in extra-curricular teaching according to Form No. 03 of the Appendix to Circular 29, stipulated in Clause 3, Article 6 of Circular 29) and do not have to carry out the procedure for registering a business of extra-curricular teaching.

So which teachers are allowed to register for extra teaching business?
Teachers in the non-public sector can organize extra teaching and learning, and can register their business according to the law to organize extra teaching outside of school.
What do organizations and individuals who organize extra-curricular tutoring outside of school need to do? Article 6 of Circular 29 clearly states: In addition to registering for business in accordance with the law, organizations or individuals who organize extra-curricular tutoring outside of school that collects fees from students must publicly announce on the electronic information portal or post at the tutoring facility the subjects that are organized for extra-curricular tutoring; the duration of extra-curricular tutoring for each subject by grade level; the location, form, and time of organizing extra-curricular tutoring; the list of tutors and the tuition fees before enrolling students in extra-curricular tutoring classes. Extra-curricular tutors must ensure that they have good moral qualities and professional qualifications appropriate to the subjects they teach.
Teachers who are teaching at schools and participate in extra-curricular teaching must report to the principal or director or head of the school about the subjects, location, form, and time of extra-curricular teaching.
Can public school teachers work part-time at an education company (with extra classes)?
If a teacher is a public school teacher, in the evenings, they can do extra work at the education company such as office work, registration..., as long as it does not affect the time and quality of the teacher's work at the public school where this person is working. However, if this teacher teaches extra classes at this education company, the extra teaching will be regulated by the regulations in Circular 29 on extra teaching and learning.
Specifically:
- Teachers are not allowed to tutor the same students they are teaching in the regular class.
- Extra teachers must report to the principal about the subject, location, form, and time of extra teaching.
- Teachers are not allowed to participate in management and operations and must not violate the prohibitions for civil servants according to regulations on anti-corruption and the Law on Civil Servants.
- No extra tutoring for primary school students, except for art, physical education, and life skills training.
