Legitimate in the digital music era

More than 10 years ago, music piracy on free music apps spurred the Listen Mindfully campaign. 10 years later, the problem is back, but in a different form.

"Original" mess

Recently, musician Nguyen Xinh Xo - the owner of hits such as De Danh and Giac Mo La - posted on his personal page about his EP Hanoi Waltz being placed on an unofficial profile on the digital music platform Spotify after more than 1 month of release.

Sharing specifically with Thanh Nien , musician Nguyen Xinh Xo said that the product was initially officially released under a verified account. However, after a while, he discovered that there was an account with the same name on Spotify but it was not verified, so he sent a synchronization request to avoid confusion not only for listeners but also in the distribution, statistics and management of the work. It is worth mentioning that after receiving the request, instead of keeping the original profile, the EP was … transferred to the unverified account mentioned above.

Below the post, singer Ha Tran also recounted her experience. Accordingly, when releasing the album Nhung con song ngon tay (finger rivers) , she discovered that there were 2 artist profiles on the Spotify platform, Ha Tran (stage name, owner) and Tran Thu Ha (real name, created by another party and profiting from it until now). Previously, the singer did not pay much attention to this, leading to the discovery that the "fake" account had recorded 100,000 followers. Thanks to the intervention of the distribution representative, she was finally able to regain ownership rights.

10 years ago, artists had headaches because their works were distributed for free, without permission, without payment. Now, copyright is still there, but in a different form, it is a question of ownership, legitimacy and proper recognition for the creator.

Singer Hong Nhung also said when launching the project Simple Beauty and Who is Bong? that: "My listeners will probably be surprised to know that up to now, all of Hong Nhung's music collections released on online platforms have not been agreed upon, or even asked through me. I always thought that singing for so many years, recording countless songs, and reaching many listeners would be a great joy, but in the near future, I will officially follow the law, requesting that online platforms that have been releasing my music collections, performed and produced by me, need to meet with my legal representative to resolve intellectual property business matters in accordance with the law."

Besides, when visiting the page of the singer Nho ve Ha Noi , it is not too difficult to see songs like The gioi bao la khong met lai, Ket cuong khong ly do, The Unsung Hero ... although not performed by Hong Nhung,... are still recorded in the official profile.

Singer Hoang Dung also faced a similar situation. He said he worked with the publisher and Spotify platform to remove his name from the songs that were not his own and spoke up, because he did not want "the audience to have misunderstandings when listening to music, nor did he or his colleagues be abused by people or units that were not partners".

Lessons to be more professional

Officially entering the Vietnamese market since 2018, Spotify's role in promoting copyrighted music cannot be denied, since then many domestic platforms have become more aware of this issue, creating a transparent market, respecting the law. However, it is the policies that lack verification and clear censorship that have caused many unfortunate incidents, causing audiences and artists to face the issue of legitimacy on the digital music platform.

Speaking to Thanh Nien , musician Nguyen Xinh Xo shared: "10 years ago, artists had headaches because their works were distributed for free, without permission, without payment. Now, it is still copyright, but in a different form, it is a question of ownership, legitimacy and proper recognition for the creator."

"My case shows a big problem that streaming platforms still lack a mechanism to strictly and transparently control artist identities. In a global music market where millions of songs are released every day, protecting the identity and ownership of works becomes even more important. I think platforms need to have a clearer ownership verification process, and artists should also proactively monitor and regularly check the appearance of their works on these platforms," musician Nguyen Xinh Xo added.

A positive sign is that many professional music distribution units have entered the market, introducing artists to "packages" of releases and tracking when putting music products on domestic and foreign digital music platforms. Male singer Dinh Bao - former member of the group AC&M - also recently introduced a comprehensive ecosystem to help artists create, release, publish and manage music copyrights in the digital age... with just one account.

It can be seen that there are still many mechanisms and policies that need to be put in place to ensure the rights of both the audience and the artists. In that journey, the domestic music industry will also become more systematic, meticulous and professional.
