Comments on the Regulations on management and use of the certification mark "Da Lat - miraculous crystallization from the good land"

(LĐ online) - On the afternoon of December 14, the Department of Industry and Trade of Lam Dong held a meeting to collect opinions for the promulgation of the Regulation on management and use of the trademark "Da Lat - miraculous crystallization from the good land" of the Provincial People's Committee in the near future.

Many products of Lam Dong have gained a foothold in the market thanks to the label "Da Lat - miraculous crystallization from the good land"

Accordingly, this Regulation regulates the management and use of the certification mark "Da Lat - Miraculous crystallization from the good land" to ensure the quality, enhance the value and efficiency of production and business of products and services of this certification mark in Lam Dong province.

The certification mark “Da Lat - miracle crystallization from the good land” is an exclusively registered trademark in the country. The trademark is used for vegetables, fruits, flowers, Arabica coffee, tea, artichokes, mushrooms and agricultural tourism products produced and traded in Da Lat city and surrounding areas.

This regulation applies to the certification mark management agency and organizations and individuals producing, trading, and using vegetables, fruits, flowers, Arabica coffee, tea, artichokes, mushrooms, and agricultural tourism products in Da Lat city and surrounding areas.

Lam Dong Provincial People's Committee is the owner of the certification mark "Da Lat - miraculous crystallization from the good land"; carries out the registration of ownership of the certification mark according to the provisions of law. Lam Dong Provincial People's Committee authorizes Da Lat City People's Committee to manage the certification mark "Da Lat - miraculous crystallization from the good land".

According to the draft of the regulation, in Chapter II, Article 10 also stipulates the Certificate of use of the certification mark "Da Lat - miraculous crystallization from the good land" including the following contents: Name and address of the organization or individual granted the certificate; Phone, Fax, Email, Website (if any); List of product types granted the certificate; Sample of product certification mark; Rights and obligations of the organization or individual granted the certificate; Full name, signature of the representative and seal of the agency managing the certification mark.

Products labeled "Da Lat - miraculous crystallization from the good land"

The certificate of use of the certification mark “Da Lat - miraculous crystallization from the good land” is made into 1 original copy and given to the using unit. The certification mark management agency opens a book to monitor the issuance and revocation of certificates. In case of request for a copy of the certificate, the certification mark management agency shall issue a maximum of 10 copies.

The certificate of use of the certification mark "Da Lat - miraculous crystallization from the good land" is valid for 3 years from the date of issue.

Annually, the certification mark management agency and the organization or individual using the mark shall take samples of products bearing the certification mark to assess product quality; the quality assessment fee shall be paid by the organization or individual using the mark according to regulations. In case there are signs of doubt about the quality of products bearing the certification mark; the certification mark management agency has the right to conduct surprise inspections and assess the quality of the products.

Organizations and individuals using certification marks are equal in rights, interests and obligations related to the certification marks. Organizations and individuals granted a certificate of use of the certification mark have the right to: Attach the certification mark on the packaging of the products that have been granted a certificate of use of the mark that they produce and trade; have the right to exploit, use and enjoy economic benefits arising from the certification mark; have the right to legally use the certification mark "Da Lat - a miraculous crystallization from the good land" protected by the State.
