The subjects of application are agencies and units under the management of Hanoi city, including: Party agencies; state agencies, Fatherland Front at all levels and socio-political organizations; public service units; other organizations and individuals related to the use of regular state budget expenditures for purchasing, repairing, renovating, upgrading assets, equipment and renting goods and services.
The regulation of the authority to decide on approving tasks and budget estimates for purchasing, repairing, renovating, upgrading assets, equipment and renting goods and services under the management of Hanoi city, including the inheritance, supplementation and abolition of the provisions of Resolution No. 29/2024/NQ-HDND dated November 19, 2024 of the City People's Council to comply with the new provisions in Decree No. 98/2025/ND-CP dated May 6, 2025 of the Government and the two-level local government organization model.
Specifically: Add the content of "repair, renovation, upgrading of assets, equipment and leasing of goods and services" to the provisions on the scope of regulation, applicable subjects, authority to decide and approve tasks and budget estimates for purchasing, repairing, renovating, upgrading assets, equipment and leasing of goods and services.
Abolish the provisions on the authority of the Chairman of the People's Committee of districts, towns and cities.
Supplementing regulations for cases where tasks arise to purchase, repair, renovate, upgrade assets, equipment, rent goods, and services serving district-level operations that need to be performed while the district-level administrative unit has not yet completed its operations to promptly remedy/handle consequences caused by natural disasters, fires, unexpected accidents, incidents, catastrophes, or other force majeure events.
Also at the meeting on the morning of June 27, the Hanoi People's Council also agreed to amend and supplement a number of Resolutions of the Hanoi People's Council regulating the management and use of public assets under the management of Hanoi city:
Specifically, unanimously approved the Resolution amending and supplementing a number of articles in Resolution No. 35/2024/NQ-HDND dated December 10, 2024 stipulating a number of decision-making authorities in the management and use of public assets and the procurement of goods and services under the management of Hanoi City; Resolution No. 27/2024/NQ-HDND dated November 19, 2024 stipulating the concession of exploitation and management of valuable architectural works and cultural and sports infrastructure works and items under the management of Hanoi City (implementing points a and b, Clause 4, Article 41 of the Law on the Capital); Resolution No. 28/2024/NQ-HDND dated November 19, 2024 regulating the use of public assets at public service units under the management of the City for business purposes, leasing, joint ventures, and associations (implementing points a and b, Clause 4, Article 41 of the Law on the Capital).
Including: Amending the provisions on the authority and tasks of the "district level" transferred to the commune level in the 3 Resolutions mentioned above;
Amending, supplementing and abolishing a number of regulations in Resolution No. 35/2024/NQ-HDND dated December 10, 2024 of the City People's Council, specifically:
Amending the authority of the City People's Council to "decide or delegate decision-making authority" in the management and use of public assets instead of the City People's Council "prescribing decision-making authority" in the management and use of public assets.
Supplementing the authority to decide or decentralizing the authority to decide on the use of public assets under local management to participate in investment projects under the public-private partnership method.
Abolish 4 decision-making authorities: (1) Authority to decide on the sale of assets such as houses, land and other assets attached to land at workplaces and public service establishments; (2) Authority to decide on the value of assets attached to land when selling workplaces and public service establishments. (3) Authority to decide on the management and use of irrigation infrastructure assets. (4) Authority to decide on assets with established ownership rights of the entire people (because these regulations are no longer under the authority of the City People's Council).
Previously, in the review report on this content, Deputy Head of the Economic - Budget Committee, City People's Council Vu Ngoc Anh said that the contents submitted by the City People's Committee for amendment closely followed and were consistent with the new provisions of the Constitution, the Law on Organization of Local Government, the Law on Amending and Supplementing 9 Laws, Decrees No. 08/2025/ND-CP dated January 9, 2025 and Decree No. 77/2025/ND-CP of the Government and the Government's new regulations on decentralization and delegation; consistent with the authority of the City People's Council.
The amendment of regulations under the authority of the district level transferred to the commune level helps to increase the initiative in managing, using and handling public assets under the management of the grassroots level; shorten the process and procedures, respond more quickly to practical needs at the local level; contribute to speeding up the arrangement and handling of surplus and unused houses and land of communes and wards after the arrangement of commune-level administrative units.
At the same time, the Committee proposed that after the City People's Council's resolution, the City People's Committee should have specific and detailed instructions as a basis for assigned units to proactively organize and implement the Resolution, ensuring consistency in understanding and implementation throughout the city.
