A series of land lots along Bac Hung Hai river were granted without authority.

Stop construction, maintain status quo

According to local residents, recently, illegal construction activities have been taking place on the land along Bac Hung Hai river, in Xuan Quan commune, Van Giang district.

Specifically, households in the above area, although not yet granted land use right certificates (red books) by competent authorities, have proceeded to build solid high-rise buildings.

Bringing the above reflection of the people to the local authorities, Mr. Hoang Hoa Cuong, Chairman of the People's Committee of Xuan Quan commune, said that upon receiving the people's reflection, the authorities sent people to inspect and requested to stop the construction and maintain the current status.

Citing the reason that he had just taken on the position of commune chairman, Mr. Cuong said he did not yet know the origin of the above land, but he admitted that the households living on the above land had not been granted red books.

According to Mr. Nguyen Quoc Chuong, Vice Chairman of Van Giang District People's Committee, the land lots in the above area were granted by Xuan Quan Sluice Management Station (Bac Hung Hai Irrigation Works Exploitation Company Limited) to officials and workers in the irrigation sector.

However, according to Mr. Chuong, the above land allocation was beyond authority and against regulations. All land lots in the above area have not yet been granted red books.

"Those plots of land were granted to households by the Xuan Quan Sewer Management Station since the 1970s and this land allocation is beyond its authority. We are reporting to the competent authority to resolve this issue. As for construction activities in this area, first of all, they must stop, maintain the current status, and no new construction activities are allowed in this area," said Mr. Chuong.

Also related to the above content, working with Dan Tri reporter, the leader of the Department of Natural Resources and Environment of Van Giang district informed that in 2021, the Chairman of Hung Yen Provincial People's Committee directed the inspection of construction violations in the above area.

The People's Committee of Van Giang district, Xuan Quan commune and Xuan Quan sewer management station went to inspect the scene.

At that time, according to the report of the People's Committee of Xuan Quan commune, in the Bac Hung Hai retirement area along the Bac Hung Hai river in this commune, there were 3 cases of construction on land that had not been permitted and recognized by competent authorities.

As soon as the construction cases were discovered, the People's Committee of Xuan Quan commune made a record of the inspection and requested the cases to stop construction and provide documents related to the origin of the land plot.

Then, the above cases only provided documents of purchase and sale between individuals without confirmation from local authorities or competent authorities.

In response to the above incident, the People's Committee of Van Giang district requested the People's Committee of Xuan Quan commune to suspend construction of the violating project to focus on reviewing and verifying the origin of land use of the violations.

The People's Committee of Xuan Quan commune must specifically identify the violators, the violations, and make a record of the violations. At the same time, the commune government must be responsible for organizing the clearance of the violating constructions if there are cases of intentional non-compliance, ensuring compliance with the provisions of the law.

Van Giang District People's Committee also requested Xuan Quan Commune People's Committee to review and clearly identify the responsibilities of collectives, individuals and specialized departments that show signs of lax management, lack of inspection and supervision, and failure to promptly prevent and detect violations, leading to violations of state management of land in the locality.

"Strictly implement the function of state management of land in the locality, especially strictly manage public land funds and land within the protection corridor of traffic and irrigation works", the content that the People's Committee of Van Giang district requested Xuan Quan commune to implement.

Land allocation without authority

Regarding the origin of the above land lots, the Department of Natural Resources and Environment of Van Giang district said: Since the 1960s, after the Bac Hung Hai Irrigation Project was completed and put into operation, along the river bank from Xuan Quan sluice to Bao Dap sluice, belonging to the two communes of Xuan Quan and Cuu Cao of Van Giang district, was abandoned.

To take advantage of the land in the corridor and the bank of Bac Hung Hai river, Xuan Quan sluice management station has issued a document handing over the land in this area to the staff and workers of the irrigation sector to increase production and build houses in this area.

Some documents confirming the allocation of land in the above area to people are from 1970 to present.

In addition, there are some cases where Bac Hung Hai Irrigation Management Company and Hai Hung Irrigation Department approved to lend land and voluntarily returned it when the state needed it; some other cases where Xuan Quan Commune People's Committee allocated land without proper authority over the periods.

The leader of the Department of Natural Resources and Environment of Van Giang district also admitted that the unit allocating land to people in the above area did not have the function of allocating land, so such land allocation was beyond its authority.

According to statistics, Xuan Quan Sewer Management Station has allocated land to 32 unauthorized cases. These cases have arbitrarily bought, sold, and transferred ownership of land to about 120 cases without following the law.

Van Giang District People's Committee said that it has sent documents to competent authorities to resolve and handle violations against households and individuals using land in the above area.
