Deputy Prime Minister Tran Hong Ha and Minister of Construction Tran Hong Minh co-chaired the Conference, with the participation of leaders of central ministries and branches. The Conference was connected online to 63 provinces and cities nationwide.
At Hai Phong City Bridge, Vice Chairman of the City People's Committee Nguyen Duc Tho chaired the meeting, along with representatives of relevant departments, branches and sectors.
According to the report at the Conference, the Ministry of Construction said that it had reviewed a total of 594 legal documents, thereby proposing to handle the decentralization and delegation of authority for 66 documents, including: 09 Laws, 01 Resolution of the National Assembly Standing Committee, 28 Decrees, 01 Decision of the Prime Minister and 27 Circulars.
The review and recommendations show that there are 80 tasks that are recommended to be decentralized and delegated, and 130 tasks that need to clearly define the authority between administrative levels. Notably, there are 123 tasks that are proposed to be transferred from the district level to the commune level, contributing to enhancing the effectiveness and efficiency of state management at the grassroots level.
The Ministry of Construction also pointed out a number of difficulties and obstacles in the process of reviewing and proposing decentralization and delegation. Notably, the issue of delimiting authority related to administrative boundaries after merging local administrative units; some contents are currently under the authority of the Prime Minister or the Ministry of Construction but are being drafted by other ministries and branches, causing difficulties in the implementation process. In addition, collecting comments from localities in a short period of time (only 03 days) to send to the Ministry of Justice for appraisal before May 25 is also identified as a major challenge, which can affect the quality and feasibility of the draft legal document.
Concluding the Conference, Deputy Prime Minister Tran Hong Ha acknowledged and highly appreciated the initiative of the Ministry of Construction in developing the Draft Decree in accordance with the direction of the Politburo on organizing the local government apparatus according to the two-level model.
The Deputy Prime Minister requested the Ministry of Construction to continue reviewing and clarifying a number of tasks that belong to the district level but need to be retained for the provincial level to implement, especially inter-district and inter-commune projects; traffic management activities; construction of key projects; tasks related to national defense, security and health, to avoid causing congestion in the implementation process after decentralization and delegation of authority.
The Ministry of Construction is also required to continue to complete the structural framework of the Draft Decree; review and adjust the scope of tasks of the Government and the Ministry that need to be decentralized to localities, based on the assessment of the practical capacity of localities; at the same time, adjust the tasks from the Central Government to ministries and branches to ensure consistency, feasibility and readiness to put the Decree into implementation from July 1, 2025.
The Deputy Prime Minister emphasized the need to continue reviewing and avoiding overlapping regulations during the process of finalizing the draft, ensuring that the Draft Decree is built on the basis of strict compliance with the principles stipulated in the Law on Organization of Local Government. At the same time, he directed the Ministry of Construction to promptly synthesize all comments and closely coordinate with ministries, branches and localities to complete the Draft, and submit it to the Government for promulgation on schedule according to Plan No. 447/KH-CP./.
