Online conference on the draft Decree detailing a number of articles and measures to implement the Law on Geology and Minerals

(LĐ online) - On May 12, the online conference on the draft Decree detailing a number of articles and measures to implement the Law on Geology and Minerals chaired by Deputy Prime Minister Tran Hong Ha took place in Hanoi, connected with provinces and cities in the country.

Attending at Lam Dong bridge point were Mr. Vo Ngoc Hiep - Vice Chairman of the Provincial People's Committee; leaders and representatives of provincial departments and branches and People's Committees of Lac Duong, Don Duong, Duc Trong districts and Da Lat city, along with representatives of related units.

In November 2024, the 15th National Assembly passed the Law on Geology and Minerals No. 54/2024/QH15 replacing the 2010 Law on Minerals, consisting of 12 Chapters and 111 Articles, regulating basic geological surveys, geological surveys of minerals; protection of unexploited geological and mineral resources; mineral activities; mineral recovery; mineral processing; finance on geology, minerals and auction of mineral exploitation rights; state management of geology and minerals within the mainland, islands, internal waters, territorial waters, contiguous zones, exclusive economic zones and continental shelf of the Socialist Republic of Vietnam. The Law takes effect from July 1, 2025.

Pursuant to Decision No. 1610/QD-TTg dated December 19, 2024 of the Prime Minister on promulgating the List and assigning the agency to preside over drafting documents detailing the implementation of the Laws and Resolutions passed by the 15th National Assembly at the 8th Session; Decision No. 575/QD-TTg dated March 12, 2025 of the Prime Minister promulgating the Plan to implement the Law on Geology and Minerals No. 54/2024/QH15, the Ministry of Agriculture and Environment (established on the basis of merging the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development) is assigned to preside over and draft a Decree detailing a number of articles and measures to implement the Law on Geology and Minerals.

In order to carry out the assigned tasks, the Ministry of Natural Resources and Environment (now the Ministry of Agriculture and Environment) established a Drafting Committee and an Editorial Team for the Decree with representatives of relevant ministries and branches, the Government Office, and the Vietnam Federation of Commerce and Industry to draft the Decree in accordance with the provisions of the Law on Promulgation of Legal Documents and submitted Submission No. 29/TTr-BNNMT dated April 26, 2025 to the Government on the promulgation of the Decree.

The conference heard a report from a representative of the Ministry of Agriculture and Environment on the draft Decree of the Government detailing a number of articles and measures to implement the Law on Geology and Minerals.

The Draft Decree detailing a number of articles and measures for implementing the Law on Geology and Minerals includes 11 Chapters with 155 Articles, including Chapter I: General provisions (from Article 1 to Article 7); Chapter II: Basic geological survey, basic geological survey of minerals (from Article 8 to Article 11); Chapter III: Mineral areas (from Article 12 to Article 22); Chapter IV: Mineral activities, mineral recovery, mineral processing (from Article 23 to Article 100); Chapter V: Closure of mineral mines of groups I, II and III (from Article 101 to Article 107); Chapter VI: Management of strategic and important minerals (from Article 108 to Article 110); Chapter VII: Management of sand and gravel in riverbeds, lakebeds and sea areas (from Article 111 to Article 117); Chapter VIII: Information and data on geology and minerals (from Article 118 to Article 125); Chapter IX: Finance on geology and minerals and auction of mineral exploitation rights (from Article 126 to Article 149); Chapter X: Specialized inspection of geology and minerals (Articles 150 and 151); Chapter XI: Implementation provisions (from Article 152 to Article 155).

The conference listened to many contributions from ministries and localities in the country.

This Decree applies to agencies, organizations and individuals participating in geological and mineral activities or having activities related to geology and minerals in the territory of Vietnam.

One of the highlights of the Law on Geology and Minerals is to empower localities to approve, monitor and use mineral resources, contributing to promoting the development of the mineral exploitation industry in a transparent, sustainable manner and in accordance with the national master plan.

According to the Ministry of Agriculture and Environment, the new law is expected to create significant changes in the management, protection and effective exploitation of national mineral resources.

At the Conference, representatives of leaders of ministries, branches and localities gave many comments on the draft Decree.

In his concluding remarks, Deputy Prime Minister Tran Hong Ha requested the Ministry of Agriculture and Environment, based on the comments of ministries, branches and localities, to absorb and complete the draft, and soon submit it to the Prime Minister for permission to issue legal documents in a shortened order for the Decree detailing the implementation of a number of articles of the Law on Geology and Minerals, meeting the requirements for submitting and issuing the decree in accordance with regulations and ensuring quality.
