Need real breakthrough solutions

Regarding the draft Law on Science, Technology and Innovation, delegate Nguyen Hai Nam (National Assembly Delegation of Hue City) said that this is a key field to help Vietnam develop sustainably.

Citing the success of South Korea, he affirmed that Vietnam needs to strongly promote basic industries and invest in high-tech fields.

Delegate Nguyen Hai Nam highly appreciated many new positive points of the draft such as increasing research autonomy, simplifying procedures, and encouraging commercialization of research results. However, Mr. Nam requested further clarification of some contents on tax incentives, the concept of “open science”, and specific policies for large research institutions.

In addition, delegate Nguyen Hai Nam also mentioned the requirement to synchronize the Law on Science, Technology and Innovation with other laws being amended such as the Law on Corporate Income Tax, the Law on State Capital Management at Enterprises, etc. to avoid overlap and increase consistency in the legal system.

Regarding the commercialization of research results, delegates emphasized the need to carefully review Articles 58 and 59 because there are signs of overlap with the Law on Intellectual Property, especially regulations related to copyright and authorship.

Participating in the discussion, National Assembly Deputy Pham Nhu Hiep, Director of Hue Central Hospital, raised many opinions from the perspective of practical research in the medical field. Accordingly, regarding the time to conduct medical research, Mr. Hiep said that there should be a flexible adjustment mechanism according to the characteristics of the industry.

Regarding the drug bidding mechanism, delegate Pham Nhu Hiep commented that it is still too formal, which can easily lead to choosing cheap but incompetent auction units. The delegate proposed that there should be a suitable "contracting" mechanism, clear about volume and results.

Mr. Pham Nhu Hiep also suggested establishing a mechanism for handling risks in research. Because in reality, not all topics are successful, there needs to be a transparent assessment framework for what are objective risks and what are subjective errors. At the same time, it is recommended to combine the concepts of "scientific integrity" and "professional ethics" to avoid redundancy, because in essence these are identical values ​​of scientific standards in Article 3.

Regarding research on new medical techniques, delegates suggested that it is necessary to determine sufficient conditions for experimental implementation without causing stagnation or stifling creativity.

Clarify the limits of authority

Regarding the Draft Law on Atomic Energy (amended), National Assembly Deputy Nguyen Hai Nam stated that the issue of nuclear weapons and a concept appearing in the draft need to be specially considered and have clear boundaries defined when included in the Vietnamese legal system.

According to the delegate, there are two major contents in this draft law that need further clarification.

Firstly, regarding the authority to decide on investment policies for nuclear power projects, the law currently delegates authority to the Prime Minister. However, due to the specific nature of the project and its profound relation to national defense and security, delegates proposed that it is necessary to supplement principles and criteria to ensure absolute security and safety, and at the same time clearly stipulate cases where large-scale projects must be submitted to the National Assembly for consideration and decision.

Second, regarding the issue of radioactive waste and radioactive sources – which have direct impacts on the environment and public health – there is currently a lack of specific regulations on the focal management agency, monitoring and handling mechanism. Delegates recommended that the draft law should be more clearly completed to ensure effective control.
