MHL Investment Joint Stock Company (MHL) has just sent a document to the National Assembly Standing Committee, the Ho Chi Minh City National Assembly Delegation, and the Ho Chi Minh City Real Estate Association to remove difficulties in determining the time to calculate land use fees for the land plot at 448 Nguyen Tat Thanh, Xom Chieu ward.

Accordingly, MHL said it signed the BT Contract on November 1, 2016 and was paid by land fund at 448 Nguyen Tat Thanh. The BT project was completed and handed over from February 2018. .

However, the company is having trouble determining the time to calculate land use fees because departments, branches and localities have not yet reached an agreement. Specifically, from 2016 to March 2025, the investor has not been handed over the land, while at the same time, a BT contract of the company in Hanoi was handed over the land in 2016. .

MHL believes that the time to determine land price is 2016 (when signing BT contract) , based on the provisions of Decree 15/2015 and Decision 23/2015/QD-TTg (investors are allocated land at the same time as signing the BT contract) .

In addition, MHL believes that determining land prices according to Decree 256/2025 is not appropriate because the BT contract was signed and completed before the effective date of the decree, and at the same time, it is necessary to comply with the non-retroactivity principle (applied according to Decree 15/2015 and Decision 23/2025/QD-TTg). .

MHL recommends that the calculation of land use fees and land rents be determined at the time of signing the BT contract; Completed volume is calculated for land use fee and land rent at the time of signing the BT contract, the remaining part is determined at the time the State allocates land. . The company also recommended removing difficulties for businesses implementing the remaining BT contracts.

Land plot No. 448 Nguyen Tat Thanh is the location of the Saigon Future project (also known as Saigon LightHouse), a high-rise apartment complex and high-end commercial services developed by MHL (member of IMG Group). The project has a scale of 38 floors above ground, 4 basements, a land area of ​​2,425 m2 and a total construction floor area of ​​42,000 m2 .
