Ho Chi Minh City: Which unit will be the investor of urban and rural planning projects at the commune level?

The Office of the People's Council and People's Committee at the commune level in Ho Chi Minh City will be assigned as the project investor under the approval authority of the People's Committee at the commune level in implementing urban and rural planning in the area.

The Department of Planning and Architecture of Ho Chi Minh City has just issued guidelines for urban and rural planning activities in the city.

The Department of Planning and Architecture (QH-KT) of Ho Chi Minh City has just issued Document No. 422/SQHKT-THUDCNS on guidance on urban and rural planning activities in the city.

Previously, on October 28, the People's Committee of Ho Chi Minh City assigned the Department of Planning and Investment to urgently review and provide specific instructions to 168 wards, communes, and special zones regarding the above content. Specifically: Review and provide instructions on problems related to investors of planning projects to locally adjust the zoning plan (QHPK) to unify implementation according to authority and legal regulations.

After reviewing, the Department of Planning and Investment commented: For local adjustment dossiers of QHPK under the approval authority of the People's Committee at the commune level, the planning appraisal unit is the Department of Economics , Infrastructure (KT-HT) and Urban/Department of Economics.

In order to have a basis for organizing planning, while ensuring independence between planning and planning appraisal (according to Clause 10, Article 17 of the Law on Urban and Rural Planning), the People's Committee at the commune level needs to assign the responsibility for planning tasks, urban and rural planning to a subordinate unit (other than the Department of Planning and Urban Development/Department of Economics) as the project investor (also known as the planning organization).

Therefore, the People's Committee at the commune level proactively considers assigning responsibility to the Office of the People's Council (PC) and the People's Committee at the commune level to act as the project investor for planning projects under the approval authority of the People's Committee at the commune level to promptly implement construction investment projects.

According to the Department of Planning and Investment, currently, the People's Committee of Can Gio commune and the People's Committee of Nhieu Loc ward have proactively issued documents assigning the task of organizing the local adjustment of the planning to the Office of the People's Council and the People's Committee under their management.

The approval of local adjustment estimates for QHPK (if any) is under the authority of the People's Committee at the commune level (the level approving local adjustment of the planning).
