Tighten the appraisal process
According to the Ministry of Health , recently, public opinion has been particularly concerned about serious violations in compulsory psychiatric assessment and treatment activities, such as giving and receiving bribes, brokering bribes, illegal use of drugs in assessment facilities, falsifying psychiatric medical records to evade criminal responsibility, etc.
These incidents not only cause outrage in society but also undermine people's trust in medical and judicial institutions.
Faced with this situation, the Ministry of Health requires medical units throughout the system to seriously implement measures to rectify compulsory psychiatric assessment and treatment, ensuring objectivity, accuracy, and compliance with the law.
The Ministry of Health emphasized the requirement that forensic and forensic psychiatric examination facilities must strictly implement the requirements, and heads of units must take full responsibility before the law if violations occur.
All appraisal activities must comply with the procedures and regulations of the Law on Judicial Appraisal and professional circulars. In particular, appraisals must only be accepted when the request dossier is complete and conclusions must only be handed over to the correct competent agency or organization.
Ensure appraiser standards
The Ministry of Health requires that appraisers must meet the prescribed standards and be properly appointed and issued with a valid card. Units are also required to strengthen internal inspection and supervision, promptly detect and handle violations, if any. Individuals and organizations that perform well will be considered for rewards.
In addition, it is necessary to strengthen inter-sectoral coordination with investigation agencies and prosecutors during the appraisal process and exchange of appraisal results, avoiding the abuse of appraisal conclusions to evade criminal responsibility.
For compulsory psychiatric treatment facilities, the Ministry of Health requires strict implementation of regulations. Facilities must ensure security, not allowing patients to leave or escape without permission; develop complete internal procedures, strengthen the camera surveillance system and strictly manage visits and items brought in.
In case of insecurity or disorder, the medical facility must immediately notify the local police for coordination in handling.
The Ministry of Health also requires that psychiatric hospitals and psychiatric clinics absolutely do not issue mental health certificates or mental health examination certificates in self-designed forms. The issuance of these documents must comply with regulations, follow the correct form, and can only be done at facilities that have self-declared themselves qualified.
Heads of units must be held responsible if there is a situation of issuing certificates in violation of regulations, creating loopholes for criminals to take advantage of to evade or reduce criminal responsibility.
The Department of Health of provinces and cities, together with the health departments of ministries and branches, are responsible for directing, supervising and organizing the strict implementation of the above contents at forensic centers, psychiatric hospitals and psychiatric clinics under their management. The implementation must be carried out immediately, ensuring effectiveness, transparency and compliance with the provisions of law.
