The development of this regulation aims to fully and promptly institutionalize the Party's guidelines and orientations, the Conclusions of the Politburo , the Secretariat, the provisions of the amended Constitution, the Law on Organization of Local Government (amended), the Law on Amendments and Supplements to 11 Laws on Military and National Defense related to the arrangement and reorganization of administrative units at all levels, synchronization in the legal system, and improvement of the effectiveness and efficiency of state management of border and national border of the Border Guard.

Report and notify decisions to restrict or suspend activities within the border belt
Reporting and notification of decisions to restrict or suspend activities within the border belt and border areas as prescribed in Point a, Clause 3, Article 11 of the Law on Vietnam Border Guard shall be carried out as follows:
1. Before deciding to restrict or suspend activities within the border belt under its management, the Border Guard Station Chief must report to the Commander of the Border Guard Command or the Head of the Border Guard Command on duty. In case of disagreement, he has the right to make his own decision and must be responsible to the Commander of the Border Guard Command and the Party Committee and Command at his level.
2. In case of border and territorial disputes; armed conflicts; enemy intrusion; other activities threatening national sovereignty , territory, and borders; riots, terrorism, hostage taking, pursuit of armed criminals; prevention of natural disasters. Based on the actual situation, the Border Guard Station Chief shall make decisions within his authority and be responsible to the Commander of the Border Guard Command and before the law.
3. After deciding to restrict or suspend activities within the border belt under its management, the Border Guard Station Chief must immediately report to the Commander of the Border Guard Command (or the Head of the Border Guard Command on duty); at the same time, notify the local foreign affairs agency, local authorities at the commune level, agencies, organizations and individuals in the border area; and notify the border management and protection forces of the country sharing the border.

Reporting and notification of decisions to restrict or suspend activities in border areas as prescribed in Point b, Clause 3, Article 11 of the Law on Vietnam Border Guard shall be carried out as follows:
1. Before deciding to restrict or suspend activities in the border area under its management, the Commander of the Border Guard Command must immediately report to the Commander of the provincial military command or the Head of the provincial military command directly in command.
2. In case of border and territorial disputes; armed conflicts; enemy intrusion; other activities threatening national sovereignty, territory, and borders; riots, terrorism, hostage taking, pursuit of armed criminals; and prevention of natural disasters. Based on the actual situation, the Commander of the Border Guard Command shall make decisions within his authority and be responsible to the Commander of the Provincial Military Command and before the law.

3. After deciding to restrict or suspend activities in the border area under its management, the Commander of the Border Guard Command must immediately report to the Border Guard Commander (or the Chief of the Border Guard Command on duty), the Commander of the provincial military command (or the Chief of the provincial military command on duty), the Chairman of the provincial People's Committee; notify the Ministry of Foreign Affairs, the provincial police, agencies, organizations and individuals in the border area; notify the border management and protection forces of the countries sharing the border.

Reporting and notification of decisions to restrict or temporarily suspend border crossings at secondary border gates and openings as prescribed in Point a and Point b, Clause 4 and Point a and Point b, Clause 5, Article 11 of the Law on Vietnam Border Guard shall be carried out as follows:
1. After deciding to restrict or temporarily suspend the passage of secondary border gates and openings, the Border Guard Station Chief must immediately report to the Commander of the Border Guard Command (or the Head of the Border Guard Command on duty); at the same time, notify the local authorities at the commune level, agencies, organizations, individuals in the border area and the border management and protection forces of the country sharing the border.
Before the end of the period of restriction or suspension of border crossings, if it is deemed necessary to continue the restriction or suspension, the Border Guard Station Chief shall immediately report to and obtain the direct consent of the Commander of the Border Guard Command (or the Head of the Border Guard Command on duty) to decide to extend the period of restriction or suspension of border crossings at the border gate or opening; at the same time, notify the local foreign affairs agency, the Ministry of Foreign Affairs; agencies, organizations and individuals in the border area; and notify the border management and protection forces of the countries sharing the border.
2. The Commander of the Border Guard Command, after deciding to restrict or temporarily suspend the passage of secondary border gates and openings, must immediately report to the Border Guard Commander (or the Chief of the Border Guard Command on duty); the Commander of the provincial military command (or the Chief of the provincial military command on duty); the Chairman of the provincial People's Committee; and at the same time, notify the border management and protection forces of the countries sharing the border.

1. The Commander of the Border Guard Command, after deciding to restrict or temporarily suspend the passage through the main border gate or bilateral border gate, shall immediately report to the Border Guard Commander (or the Chief of the Border Guard Command on duty); the Commander of the provincial military command (or the Chief of the provincial military command on duty); the Chairman of the provincial People's Committee; and at the same time notify the local authorities at the commune level, agencies and organizations in the border area and the border management and protection forces of the country sharing the border.

Before the end of the period of restriction or suspension of border crossings, if it is deemed necessary to continue the restriction or suspension, the Chairman of the Provincial People's Committee must immediately report to and obtain direct consent from the Prime Minister to extend the period of restriction or suspension of border crossings at the main border gate or bilateral border gate; at the same time, notify the local authorities of the countries sharing the border.
