What types of real estate transactions are cleared by tax authorities?

Speaking to a reporter from Nguoi Lao Dong Newspaper on the morning of September 19, a leader of the Ho Chi Minh City Tax Department said that in order to clear up some of the more than 8,000 real estate records that were "frozen" because they had to wait for the Ho Chi Minh City People's Committee to guide them on applying the new or old land price list, the Tax Department has directed local units to resolve some records of transferring and donating real estate.

Specifically, real estate transfer documents for sellers with only one house in their name, and real estate gifts from blood relatives will be resolved soon.

Because these transactions are exempt from personal income tax, the procedure for handling purchase and sale records of the person whose name is on a house or the person donating the house or land does not depend on the land price list as the basis for tax calculation.

Regarding real estate transactions, because Ho Chi Minh City has not yet issued a new land price list, it has led to a huge bottleneck in handling real estate transfer records, land use conversion, etc. when the 2024 Land Law takes effect from August 1.

To resolve the problem, the Ho Chi Minh City Tax Department recently proposed to the city government that real estate records arising from August 1 to before the date the Ho Chi Minh City People's Committee issued a decision to adjust the new land price list, apply the old land price list of the period 2020 - 2024.

"If the Ho Chi Minh City People's Committee announces that the old land price list can be applied, the tax authority will focus on resolving and clearing the congestion of real estate records," said the leader of the Ho Chi Minh City Tax Department.
