Decree issued on refurbished goods under the Comprehensive and Progressive Agreement for Trans- Pacific Partnership (CPTPP Agreement).
Accordingly, refurbished goods are products listed according to product codes in Appendices I, II, III, IV and V attached to this Decree; made up entirely or in part of restored materials;
Has a shelf life similar to the shelf life of the same goods when unused;
Perform all functions as the functions of the same type of goods when not in use, with the quality and performance unchanged or similar to the quality and performance of the same type of goods when not in use;
The warranty is the same as the warranty that applies to the same item when it is unused.

According to the Decree, the label of refurbished goods must have the phrase "Refurbished goods" that can be read with the naked eye and must meet the following conditions: Have an import license; Meet the regulations on rules of origin of goods according to the CPTPP Agreement;
Comply with relevant regulations of Vietnamese law and specialized laws currently applied to new imported goods of the same type. In particular, depending on the specific case, there are regulations on: product labels, product quality, standards, technical regulations, energy efficiency, radiation safety, network information security, measurement, environmental protection, intellectual property protection, and other regulations.
According to the new regulations, when put into circulation on the market, the original label or secondary label of refurbished goods must display in Vietnamese the phrase "Refurbished goods" in a position and with a size that can be seen and read with the naked eye.
Import license for refurbished goods is valid for not less than 12 months.
Refurbished goods may only be imported into Vietnam with a license from a specialized management ministry as assigned in Appendix I, II, III, IV and V of this Decree (licensing authority).
Import licenses for refurbished goods include: Import licenses for batches of goods; Import licenses with a term.
The Decree stipulates that a batch import license is granted for refurbished goods the first time these goods are imported into Vietnam.
Refurbished goods with the same name, type, product code and belonging to the same enterprise are granted a Refurbished Code, after being granted an import license for 3 times in a batch (for the same importer or for different importers), will be transferred to the temporary import license regime.
The licensing authority shall prescribe the validity period of the import license for a limited period but not less than 12 months.
A temporary import license does not limit the quantity of refurbished goods imported under the license during the license's validity period.
Regarding procedures for importing refurbished goods, the Decree clearly states that traders importing refurbished goods must submit or present the following documents to the Customs authority: Certificate of origin of goods according to the CPTPP Agreement (submitted or presented according to legal regulations);
Refurbished goods import permit or document authorizing the import of refurbished goods when the Refurbished Code is suspended or revoked (present original).
Other necessary documents and papers prescribed by Vietnamese law and specialized laws applicable to new goods of the same type when carrying out import customs procedures (submitted or presented according to legal regulations).
