Amended Law on HigherEducation reduces administrative procedures
At the workshop to collect opinions on the policy of building the revised Law on Higher Education organized by the Ministry of Education and Training on the morning of May 15 at Ho Chi Minh City University of Law, Deputy Minister of Education and Training Hoang Minh Son said that this is a fundamental legal document that guides the long-term development of the entire education sector.
According to Mr. Son, in recent years, Vietnamese higher education has achieved many remarkable achievements, but there are still many shortcomings that need to be overcome. The new context poses urgent requirements for law amendments, including the trend of education development in the world , the rapid development of artificial intelligence and digital transformation. On the other hand, society is placing expectations on this law amendment and it will create a legal corridor for higher education institutions to break through and develop more strongly in the coming period.

"The length of the revised Law on Higher Education this time is only about 50% compared to the 2018 Law on Higher Education. The number of guiding documents in terms of pages has also been reduced by about half. The goal is to simplify and make the education and training system coherent, avoiding overlap between current legal regulations," said Mr. Son.
Accordingly, the draft Law on Higher Education (amended) will inherit the unchanged provisions of the current Law on Higher Education (>55%); Not duplicate provisions with the Law on Education and the amended Law on Education, the Law on Teachers, the Law on Vocational Education, the Law on Science, Technology and Innovation; At the same time, reduce the number of articles and chapters, reduce the number of processes by 50%, and reduce at least 50% of administrative procedures.
The drafting board of the revised Law on Higher Education of the Ministry of Education and Training said: The draft will integrate duplicate content and abolish many detailed regulations related to the conditions for opening majors, conditions for implementing training programs and training organization processes. This aims to reduce at least 50% of administrative procedures, through integrating the process of opening majors with the process of registering training activities, on the basis of applying training program standards and university education institution standards. The draft also aims to give autonomy to higher education institutions in developing and implementing licensed training programs, except in the fields of health, teachers, law, security and defense.
6 policy groups in the revised Law on Higher Education
Director of the Department of Higher Education (Ministry of Education and Training) Nguyen Tien Thao outlined 6 policy groups of the revised Law on Higher Education, including:
1. Improve the effectiveness of state management, create an advanced university governance system.
2. Modernize training programs and methods, apply advanced technology and promote lifelong learning.
3. Positioning higher education institutions as centers of research and innovation associated with training high-quality human resources.
4. Strengthen resource mobilization and improve investment efficiency in modernizing higher education.
5. Develop a team of excellent lecturers and scientists and a creative and honest academic environment.
6. Change the approach to quality management in quality assurance activities.

Policy Group 1 is expected to stipulate that the subjects of application are higher education institutions and educational institutions with higher education activities. Types of higher education institutions: National universities, regional universities, universities, colleges, academies...
Policy 5 will stipulate principles in the Law on university autonomy and management of teaching staff, including recruitment of foreign lecturers, working regime, salary and income, authority to appoint positions, etc.
Director of the Department of Higher Education Nguyen Tien Thao emphasized that university autonomy is the initiative of higher education institutions in deciding on activities according to legal regulations. The new draft law no longer applies conditional autonomy as in the current law. Autonomy - accountability, quality assurance are consistent in all activities of higher education.
