Amended Law on Organization of Local Government: Strengthening the duties and powers of the Chairman of the People's Committee of the commune and ward

Law No. 72/2025/QH15 (Amended Law on Organization of Local Government) was passed by the 15th National Assembly of the Socialist Republic of Vietnam, 9th Session on June 16, 2025 and took effect immediately after passage.

In order to strengthen the role and responsibility of the head according to the suggestions of the delegates, the draft law has completed the content of the distinction between the general tasks and powers of the People's Committee and the specific tasks and powers of the Chairman of the People's Committee in the direction of increasing the authority of the new Chairman of the People's Committee at the commune level. According to the provisions of this law, the Chairman of the People's Committee at the commune level has 17 tasks and powers; the Chairman of the People's Committee at the ward level has 23 tasks and powers.

Duties and powers of the Chairman of the Commune People's Committee (Article 23 of the Law on Organization of Local Government)

1. Lead and direct the work of the People's Committee; convene and chair meetings of the People's Committee.

2. Lead and direct the implementation of tasks of implementing the Constitution, laws, documents of superior state agencies and of the People's Council and People's Committee at the same level; inspect and handle violations in the process of implementing the Constitution and laws in the locality.

3. Lead and be responsible for the operation of the state administrative apparatus, ensuring the unity and continuity of the administration; implementing administrative reform, public service reform, and civil servant reform in state administrative agencies in the area; effectively applying information technology and digital transformation in the operations of local governments at their level, in handling administrative procedures and providing public services in the area according to the provisions of law.

4. Lead, direct, urge and inspect the work of specialized agencies and other administrative organizations under the People's Committee at the same level.

5. Direct and be responsible for organizing the implementation of local budget estimates; effectively manage and use investment capital, finance, budget sources, public assets, and infrastructure assigned in the area according to the provisions of law and decentralization of the Provincial People's Committee.

6. Direct and organize the implementation of socio -economic development tasks, development of sectors and fields, development of private economy, development of science and technology, innovation and digital transformation in the area; organize the implementation of state management in the locality in the fields of economy, land, agriculture, rural areas, resources, environment, trade, services, industry, construction, transportation, education, health, law making, judicial administration, judicial support, internal affairs, labor, information, culture, society, tourism, physical education and sports in the area according to the provisions of law.

7. Direct and organize the implementation of foreign affairs tasks, ensure national defense, security, order and social safety in the locality according to the provisions of law; protect the assets of agencies and organizations, protect the life, health, freedom, honor, dignity, property, other legitimate rights and interests of citizens, ensure human rights; prevent and combat crimes and other violations of the law in the locality according to the provisions of law.

8. Direct and organize the implementation of policies on ethnicity and religion; preserve and promote the cultural identity of ethnic minorities and religious followers in the area according to the provisions of law.

9. Direct and be responsible for organizing the implementation of planning types approved by competent authorities in the area; manage markets, commercial centers, tourist attractions, preschools, primary schools, secondary schools, medical facilities, and socialwelfare facilities under its authority; maintain local cultural traditions, manage cultural, sports, and entertainment facilities in the area according to the provisions of law.

10. Direct and organize the implementation of recruitment, use, and management of civil servants and public employees in the area according to the provisions of law and decentralization of superior state agencies; decide to appoint, dismiss, transfer, and remove heads and deputy heads of specialized agencies, other administrative organizations, and public service units under the People's Committee at one level; decide to temporarily suspend the work of Vice Chairmen of the People's Committee at one level, heads of specialized agencies, other administrative organizations, and public service units under the People's Committee at one level.

11. Direct and promptly handle emergency situations related to natural disasters, epidemics, and catastrophes in the area.

12. Responsible for providing essential public services in the area regarding lighting, water supply, wastewater and waste treatment, environmental sanitation, and fire prevention and fighting according to the provisions of law.

13. Organize the implementation of citizen reception, complaint and denunciation settlement, prevention and combat of corruption, waste and negativity in the activities of local authorities at their level and in socio-economic activities in the area according to the provisions of law.

14. Guide and inspect the self-management activities of villages in the area according to the provisions of law.

15. Issue decisions and other administrative documents on matters within its duties and powers; abolish, amend, supplement, or replace documents it issues when deemed no longer appropriate or illegal.

16. To represent the People's Committee at its level to decide on matters under the authority of the People's Committee, except for the contents specified in Clause 2, Article 40 of this Law and report to the People's Committee at the nearest meeting.

17. Perform assigned and delegated duties and powers and other duties and powers as prescribed by law.

Duties and powers of the Ward People's Committee

The Ward People's Committee performs the tasks and powers prescribed in Article 22 of this Law and the following tasks and powers:

1. Draft and submit to the People's Council of the same level for consideration and promulgation of resolutions to perform the tasks and powers prescribed in Clauses 1, 2 and 3, Article 24 of this Law and organize the implementation of resolutions of the People's Council of the same level;

2. Implement linkages and cooperation in economic development, urban infrastructure, transportation, and environment with local authorities in neighboring wards according to the decentralization of the Provincial People's Committee and legal regulations, ensuring synchronous, interconnected, unified, and harmonious development among urban areas in the area;

3. Collect fees and charges in the area according to the provisions of law and decentralization of the provincial local government;

4. Organize the implementation of policies to encourage the development of urban economy, trade, services, finance, science and technology development, innovation, and digital transformation in accordance with the characteristics of the urban area according to the provisions of law;

5. Organize the implementation of urban renovation, beautification and development programs according to the provisions of law and decentralization of the Provincial People's Committee.

Duties and powers of the Chairman of the Ward People's Committee

The Chairman of the Ward People's Committee performs the duties and powers specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 15, 16 and 17, Article 23 of this Law and the following duties and powers:

1. Direct and organize the implementation of urban development planning, programs, and plans, ensuring synchronous, interconnected, unified, and harmonious development among urban areas in the area; the use of urban land funds for the construction of urban infrastructure works according to decentralization and regulations of law;

2. Direct and organize the implementation of measures to protect the urban environment, manage waste and wastewater, control environmental pollution, protect green spaces and urban ecosystems according to the provisions of law;

3. Direct and be responsible for the management, maintenance and repair of urban infrastructure; inspect compliance with the law in the construction of houses and construction works in urban areas according to the provisions of law;

4. Direct and organize the implementation of measures to ensure security, order, crime prevention, traffic safety, traffic congestion prevention, fire and explosion prevention, and ensure a safe living environment for urban residents according to the provisions of law;

5. Direct and organize the implementation of urban population management and prevention of social evils in urban areas according to the provisions of law;

6. Perform the tasks of managing and protecting urban space, architecture and landscape;

7. Guide and inspect the self-management activities of residential groups in the area according to the provisions of law.
