Recently, banners have been hung all over the streets around the Dong Thay historical site to protest the investment policy of the relic restoration and embellishment project implemented by the People's Committee of Thanh Xuan District.

Many local people said that from 1970 - 1980, many households lived in this area. By 1990, Dong Thay mound was recognized as a historical relic. Over the past few decades, people's lives have remained stable, without any land disputes. During the process of land use and construction on the land, families have not been administratively sanctioned by any competent authority in the field of land and construction.

In 1997, the Hanoi People's Committee issued Decision No. 1185/QD-UB assigning the Hanoi Monuments and Landscapes Management Board (BQL) to use more than 26,700 m2 of land in the Dong Thay mound area. to manage and preserve.

"According to the provisions of the 1993 Land Law, if you want to transfer land that is currently being used to another person, the competent authority must have a decision to reclaim the land. However, the Hanoi People's Committee did not have a decision to reclaim the land but issued a decision to transfer the land to the Management Board, which is contrary to Article 19 of this Law and Decree No. 88 of the Government , issued on August 17, 1994," a citizen analyzed.

Through Thanh Nien 's investigation, in 1997, when issuing Decision No. 1185/QD-UB, assigning the Management Board to use more than 26,700 m2 of land in the Dong Thay mound area for management and conservation, the Hanoi People's Committee also assigned the Management Board to coordinate with the Thanh Xuan District People's Committee to establish a council to clear the land and compensate for damage to land and property for users whose land was recovered according to regulations. However, after that, the site clearance was not carried out by the authorities.

In 2010, the Hanoi People's Committee issued Document No. 862/UBND-KHDT assigning the Thanh Xuan District People's Committee to be the investor to establish and implement the Dong Thay Mound restoration and embellishment project. Notably, at this time, the land area for the zoning project was only over 15,000 m2 .

The remaining 11,700 m2 was granted to the military unit to build the headquarters of Thanh Xuan Trung Ward People's Committee and to give land to Mr. NPQ and NGH's family... It was not until 2018 that Thanh Xuan District People's Committee approved the project to restore and embellish the Dong Thay mound historical relic, with a total investment of more than 234 billion VND.

Believing that the land allocation in 1997 under Decision No. 1185/QD-UB was not implemented in accordance with the law, dozens of households in Group 4 continued to protest against the legal documents issued later to serve the investment process of the Dong Thay Mound relic restoration project.

Enforcement will definitely be carried out after Tet.

As a family subject to forced eviction to serve the project, Ms. Tran Kim Tuyen (49 years old, residing in Group 4) said that her family, as well as other households living for decades around the Dong Thay mound area, always comply with the State's policies and guidelines. However, the investment in the project must follow legal procedures and cannot be based on decisions that appear to be illegal.

"I request the competent authority to cancel the issued decisions and carry out investment procedures in accordance with the regulations and order of the law to ensure the rights of the family as well as dozens of households subject to forced land acquisition for this project," Ms. Tuyen expressed.

When the press questioned why the Hanoi People's Committee arbitrarily adjusted the planning and granted more than 11,700 square meters of relic land to units without the consent of the Ministry of Culture, Sports and Tourism (the unit that issued the decision to classify the Dong Thay Mound relic as a historical relic - PV), the Thanh Xuan District People's Committee said that this content was not under the authority of the district. However, according to the documents that Thanh Xuan District is keeping, the city has issued 3 documents with the content of allocating land to individuals and agencies.

Recently, speaking with Thanh Nien , a Thanh Xuan District official said that the project will be implemented in 2 phases; in which phase 1 will renovate and embellish construction items within an area of ​​about 8,700 m2 . To serve phase 1, the district will issue decisions to enforce 58 cases. "The district's enforcement plan is under construction; when enforcement is carried out, it will be specifically announced to the people and will definitely take place after Tet," the official added.

Regarding the content that people think that compensation needs to be satisfactory, the Thanh Xuan District official said that the compensation has been carried out by the authorities in accordance with legal procedures.

The area of ​​Dong Thay mound used to belong to the Cu Chinh - Nhan Muc village field, with the colloquial name Ke Moc, including 12 villages, later also had the Chinese name Nhan Muc. At the end of 1426, in the battles to besiege and liberate Dong Quan citadel (present-day Hanoi) from the domination of the Ming army, the Lam Son ( Thanh Hoa ) insurgent army of Le Loi had the opening battles of victory at Nhan Muc bridge, destroying a large force of the Ming army stationed there.

After those two glorious battles, the land in this area was called by the locals as That Tinh mound or That Tinh tomb area and gradually became the popular name Dong Thay mound as it is today (enemy corpses were piled up in piles, mounds). Due to these special values, Dong Thay mound relic has been recognized as a historical relic.
