Launching a peak period of fighting to prevent and repel smuggling, trade fraud and counterfeit goods

Market management forces strengthen inspection and control of goods at business establishments in the province.

Specifically, the Chairman of the Provincial People's Committee requested the Provincial Steering Committee against smuggling, trade fraud and counterfeit goods (Provincial Steering Committee 389), departments, branches, sectors, People's Committees of districts, cities and towns, based on their functions and tasks, to study, thoroughly grasp and direct the implementation of the contents as required by the Prime Minister in the Official Dispatch. At the same time, continue to seriously and effectively implement the directions of the Provincial People's Committee on improving the effectiveness of the work against smuggling, trade fraud and counterfeit goods in the province in the documents No. 363/KH-BCĐ389 dated January 22, 2025; No. 1846/UBND-KGVX dated April 18, 2025; No. 1877/UBND-CNXD dated April 21, 2025; No. 2157/UBND-CNXD dated April 29, 2025.

The Department of Industry and Trade - the Standing Agency of the Provincial Steering Committee 389 urgently studies and proposes the establishment of a Working Group to combat, prevent and repel crimes of smuggling, trade fraud, counterfeit goods, copyright infringement, and infringement of intellectual property rights with appropriate members during the peak period from May 15, 2025 to June 15, 2025; at the same time, develop a plan to ensure synchronous and effective implementation in the province; synthesize and report to the Provincial People's Committee before May 21, 2025.

Direct the market management force to preside over and coordinate with relevant agencies and units to resolutely carry out inspections and strictly handle cases of smuggling, production and trading of counterfeit goods, goods infringing on intellectual property rights, goods of unknown origin, especially violations in the e-commerce environment.

Based on the results of review, inspection and handling to assess and point out the causes, conditions of violations, loopholes and inadequacies in legal regulations or management mechanisms that violators take advantage of, to recommend to competent authorities solutions to overcome, contributing to perfecting the institution, ensuring effectiveness in the fight against smuggling, trade fraud and counterfeit goods, especially in the field of e-commerce.

At the same time, monitor, guide and urge agencies and units to seriously implement the contents of the Document; summarize and report the results of the peak implementation to the Provincial People's Committee, the Provincial Steering Committee 389, the National Steering Committee 389 (Standing Office of the National Steering Committee 389) according to regulations.

The provincial police closely coordinate with relevant authorities to identify, detect and handle organizations and individuals with signs of smuggling, trade fraud, production and trade of counterfeit goods, intellectual property infringement, goods of unknown origin and related acts; deploy professional measures to combat and criminally handle organizations and individuals who seriously violate the provisions of the law in order to promptly deter and warn.

Closely coordinate with the People's Procuracy and the People's Court to strictly investigate, prosecute and try cases in accordance with the law, especially large-scale and serious cases of smuggling, trade fraud and counterfeit and banned goods. The process of fighting must pay attention to clarifying the roles and responsibilities of organizations and individuals in the management, licensing, inspection, control of export, import, circulation... of production materials and goods, and strictly handle acts of corruption and negativity (if any) in accordance with regulations.

The Department of Health shall step up inspection, control and strictly handle the trading and business of counterfeit drugs, smuggled drugs, fake pharmaceuticals, drugs of unknown origin; continue to recall counterfeit medicines, fake milk and fake health protection foods discovered in the province; at the same time, strengthen measures to improve the effectiveness and efficiency of pharmaceutical and food safety management.

Require scientists and managers of the health sector in the area to sign a commitment not to advertise or introduce false information, information lacking scientific basis or basis, or to exaggerate the features and uses of products without carefully verifying legal documents related to the product; to be responsible before the law if there is any fraudulent advertising.

The Department of Agriculture and Environment strengthens inspection and strictly handles violations related to forestry products, aquatic products, production and trade of fake plant varieties, livestock, fertilizers, and health protection foods.

The Department of Science and Technology closely coordinates with relevant agencies to inspect and manage the state on standards, quality, industrial property, barcodes, and traceability of products and goods of organizations and individuals producing and trading in Phu Tho province.

The Department of Culture, Sports and Tourism shall preside over and coordinate with the Provincial Police, the Department of Health, the Department of Industry and Trade and relevant agencies to strengthen inspection activities on compliance with legal regulations on advertising, especially advertising in the press, online environment, social networking platforms, publications related to smuggling, trade fraud, counterfeit goods and infringement of intellectual property rights; strictly handle acts of false statements and advertisements, exaggerating the uses of products without scientific basis.

Phu Tho Customs has done a good job in professional work, collecting information, and closely coordinating with relevant forces to promptly detect and handle smuggling, tax evasion, and transportation of prohibited goods and counterfeit goods of Vietnamese origin.

Phu Tho Newspaper, Phu Tho Radio and Television Station proactively coordinate with functional forces to provide full and accurate information on the activities of monitoring, inspecting, controlling and handling violations of the market management force. Promote propaganda, disseminate full and accurate information and regulations of the law on business activities, protect consumer rights, new methods and tricks of related crimes on mass media so that agencies, organizations and individuals can raise awareness, sense of compliance, proactively prevent and actively coordinate with functional agencies and units in preventing, detecting and combating violations of the law.

The People's Committees of districts, cities and towns direct branches, units and People's Committees of communes, wards and towns to effectively carry out State management of organizations and individuals engaged in production and business activities in the area according to their authority; strengthen the work of preventing, detecting, combating, stopping, handling and propagating to repel acts of smuggling, trade fraud, counterfeit goods, copyright infringement and infringement of intellectual property rights.
