On regulations on decentralization, delegation, and determination of authority in the fields of construction and transportation

Following the direction of the Government and the guidance of the Ministry of Justice , the Ministry of Construction is revising the draft Decree into two Decrees, including: Decree on the decentralization of local government authority according to the two-level local government organization model in the fields of construction and transport and Decree on decentralization and delegation of authority in State management of construction and transport (reflecting the content of decentralization and delegation of authority between the Central and local governments).

Regarding the draft Decree on the division of authority of local authorities according to the 2-level local government organization model in the fields of construction and transportation, the group of tasks of district-level authorities (90 tasks) will basically be transferred to the commune level for implementation.

Regarding the draft Decree on decentralization and delegation of powers in State management of construction and transportation (between the Central and local levels), 21 authorities of the Government and the Prime Minister are decentralized and assigned to the Minister; 3 authorities of the Government and the Prime Minister are decentralized and assigned to localities; 28 authorities of the Minister and specialized agencies under the Ministry are decentralized to local authorities...

Decentralization and delegation of power are carried out on the principle of ensuring the Government's unified management rights, promoting the initiative, creativity and self-responsibility of local authorities, and associated with the inspection and supervision mechanisms of ministries and central agencies.

Many contents and comments were proposed by ministries and branches at the conference.

Concluding the conference, Deputy Prime Minister Tran Hong Ha praised the urgent and determined working spirit of the Ministry of Construction and a number of related ministries and branches. He requested that decentralization must ensure principles, careful calculations, and be consistent with reality.

In particular, pay attention to the criteria and principles of clear people and clear tasks from the central to local levels. At the same time, analyze and evaluate specific professional tasks associated with implementation conditions.

It is necessary to clarify the conditions for implementation, decentralization, and authorization along with supervision and inspection; this is considered an important basis to improve the effectiveness and efficiency of state management in the new period.
