Purchase or convert other housing functions into official housing after merger

After the process of reorganizing and merging administrative units, the issue of public housing for cadres and civil servants has become one of the major challenges for local governments. Currently, many provinces and cities are having many solutions to this problem.

The Ministry of Home Affairs has just submitted a document to the Government on the project to reorganize provincial-level administrative units in 2025. The Government's draft project identifies that 52 provincial-level administrative units will be reorganized. After the reorganization, the country will have 34 provincial-level administrative units, including 6 centrally-run cities.

Many localities proactively supply

According to information from the Dong Nai Provincial People's Committee, after the province's merger, about 1,600 civil servants from Binh Phuoc came to Dong Nai to work. The Provincial People's Committee has directed the review and proposed the construction of about 7 new public housing areas. The functions of redundant headquarters after the merger, headquarters no longer in use, dormitories, and vacant social housing areas will be converted to be renovated and upgraded into public housing.

In addition, the Provincial People's Committee has worked directly with investors of commercial housing and social housing projects in Bien Hoa city, requesting them to speed up construction and completion progress to meet the housing needs of people and civil servants in general.

The Chairman of Hai Phong City People's Committee has also just requested Thai - Holding Joint Stock Company to arrange 1 block (about more than 400 apartments) in the social housing project at Warehouse 3 Lac Vien (No. 142 Le Lai), May Chai Ward and Cau Tre Ward, Ngo Quyen District for Hai Duong officials to rent for a period of 2-3 years.

Hai Phong City leaders also requested CRV Real Estate Group Joint Stock Company to soon start construction of apartment buildings combined with commercial services on land lots from HH1 to HH4 in the extended Do Muoi Street area on May 13, 2025 and complete on May 13, 2027; when opening for sale, priority will be given to Hai Duong officials.

Director of Ca Mau Department of Construction, Mr. Du Minh Hung said: In the near future, Ca Mau guesthouse and Minh Hai guesthouse will be arranged as accommodation for officials from Bac Lieu province to work. The representative of the Khanh Hoa Provincial Department of Finance proposed to the provincial and departmental leaders to arrange 12 apartments meeting the prescribed standards at the Provincial Party Committee Guest House (No. 2 Tran Hung Dao). The estimated cost of renovation and repair is about 20 billion VND and will be completed and put into use by the end of 2025.

Some provinces will invest in building new public housing areas, and at the same time, renovate and repair surplus agency headquarters after mergers and consolidations into public housing. This is to meet the housing needs of officials and civil servants when merging provinces, and to avoid wasting existing public assets.

"In addition to the State budget, it is also possible to mobilize private capital to participate in the form of socialization of public housing projects in the form of contract assignment or bidding. There should also be preferential policies and mechanisms to encourage businesses to participate in building houses for this purpose. During the implementation process, it is necessary to inspect, supervise and ensure that the development of public housing complies with the law," said Mr. Nguyen Huu Cuong, Chairman of the Hanoi Real Estate Club.

Instructions from the Ministry of Construction

For localities that do not have favorable conditions for available housing funds, or are still facing difficulties and problems, the Ministry of Construction has issued Document No. 3089/BXD-QLN guiding the People's Committees of provinces and centrally-run cities to implement policies on public housing after administrative unit rearrangement.

According to the above instructions, localities can invest in building public housing or buy commercial housing as public housing.

For investment in the construction of public housing, the People's Council at the provincial level shall decide on the investment policy or assign the People's Committee at the same level to decide on the investment policy of the project to invest in the construction of public housing to arrange for people who come to work in the locality to rent. The Chairman of the People's Committee at the provincial level shall decide on the investment and decide on the investor of the project to invest in the construction of public housing.

For projects to purchase commercial housing for official housing, the Provincial People's Council shall decide on the investment policy or assign the People's Committee at the same level to decide on the investment policy for projects to purchase commercial housing to arrange for rent to subjects in this case. The provincial housing management agency (Department of Construction) shall report to the Chairman of the Provincial People's Committee for investment decision.

The Housing Law also allows the conversion of functions from other housing to public housing. That is, the conversion of functions from social housing belonging to public property to public housing. The conversion of functions from resettlement housing belonging to public property to public housing.

The Ministry of Construction recommends that localities, based on the guidance and their local public housing needs, have plans to invest in new construction, purchase commercial housing or convert the functions of other housing projects to public housing to ensure that officials have a stable life and peace of mind at work.

In addition, the Ministry of Construction also requested localities to review their provincial housing development plans. In cases where the public housing quota has not been allocated or the public housing quota for subjects eligible to rent public housing in the locality is not suitable to the locality's needs, research and adjustment should be made to ensure that it is suitable to the locality's public housing needs and medium-term public investment plan for the period 2026 - 2030.

Sharing with the press, Dr. Nguyen Tien Dinh, former Deputy Minister of Home Affairs, expressed his opinion: "It is necessary to arrange public housing for officials. I think that the local government where the new administrative unit is selected as the headquarters has the responsibility to arrange public housing for officials, civil servants and workers, which is inevitable. Although currently, organizing the public housing system of the new provinces after the merger is not simple, it still has to be done, because this is urgent."
