For over 20 years, 99 households from the former Ha Tay province (now Hanoi) moved to Hamlet 5, Quang Son commune, Dak Nong district, Dak Lak province (now Quang Son commune, Lam Dong province) to settle and start a new life under the migration program, engaging in new economic activities...
...they have still not been issued land use right certificates. Some households that had previously been granted certificates had them revoked, causing them significant hardship.
In 2002, following the policy of resettlement, Mr. Pham Hong Duong's family, along with 98 other households, moved to the Ha Tay New Economic Zone in Hamlet 5, Quang Son Commune to start a new life. After many years of petitioning, in 2013, Mr. Duong's family was granted Land Use Right Certificate No. BR463229 for plot No. 19, map sheet No. 23, with an area of nearly 11,000m2. However, in 2022, when processing the land subdivision and transfer, his Land Use Right Certificate was confiscated by authorities on the grounds that the land allocation was incorrect, as the entire area of the plot falls within the boundaries of Coffee 15 One-Member Limited Liability Company.
Mr. Duong said that when his family received the land use right certificate, they were very happy, thinking they would have a better life than in their old place, but unexpectedly, it was confiscated by the authorities. After many appeals, the local government returned the certificate. However, since then, the certificate cannot be used for loan transactions, transfers, or mortgages. "I am even more surprised, worried, and confused to learn that the land in the new economic zone, belonging to all the relocated households, has not yet been issued land use right certificates because this area is under the management of another unit," Mr. Duong worried.
Similarly, in 2013, Mr. Le Dinh Binh's family was granted a land use right certificate for an area of over 5,000 square meters at plot number 4, map sheet number 23. In 2022, when registering changes and updating his citizen identification card number, Mr. Binh's land use right certificate was revoked. The reason given by the authorities was that the entire granted land area belonged to the One-Member Limited Liability Company, Coffee 15. Mr. Binh expressed his frustration, stating that since the revocation of his land use right certificate, residents of the new economic zone have repeatedly petitioned, including during meetings with constituents, and the local government has repeatedly promised to resolve the issue… But to date, there have been no results, and the people here are living in a state of weary waiting, insecurity, and anxiety.
According to documents, on January 23, 2002, the People's Committee of Dak Lak province issued a document agreeing in principle to accept 100 households from Ha Tay province into the National Defense Economic Project of Company 53, Quang Son commune. According to the resettlement contract dated January 24, 2002, between the following units: the Ha Tay Provincial Resettlement and New Economic Zone Sub-Department, the Dak Lak Provincial Resettlement and New Economic Zone Sub-Department, the People's Committee of Dak Nong district (formerly), and the investor of the Quang Son National Defense Economic Project, Ha Tay province was responsible for resolving all policies and entitlements correctly, fully, and promptly; the People's Committee of Dak Nong district was responsible for allocating residential land and agricultural land and fully implementing all policies and entitlements for the resettled households in the project area.
"According to the original plan, each household was to be allocated 400 square meters of residential land and 1 hectare of agricultural land. To date, no household in the entire village has been allocated residential land; only a few households have been issued land use right certificates, but these are not valid for transactions."
Do Huu Thanh, Party Secretary and Head of Village 5, said:
According to Mr. Thanh, due to the difficult living conditions in the new economic zone and the lack of land use right certificates, many households who were previously relocated have returned to their hometowns or moved elsewhere. Currently, only about 25 households remain in the village. Some households eligible for housing support have not received assistance, and some households needing bank loans have not been granted them… Therefore, they earnestly hope that the competent authorities will consider and promptly allocate land so that the people can stabilize their lives and feel secure in their production.
According to the leaders of Quang Son Commune People's Committee, after a review and inspection by relevant authorities, it was concluded that the issuance of land use right certificates to some households in the new economic zone of Hamlet 5 was not in accordance with the law. At the time of issuance, the land had not yet been handed over to the local authorities for management and allocation. Responding to the legitimate needs and aspirations of the people, the local authorities repeatedly petitioned the competent authorities to resolve the issues and promptly allocate land to the households in accordance with the law. In October 2021, the People's Committee of Dak Nong Province (formerly) issued a decision to reclaim 900 hectares from the enterprise and hand it over to the local authorities for management and allocation. The land reclamation was due to the voluntary return of the land by the One-Member Limited Liability Company Coffee 15. The proposal to hand over the land to the local authorities was approved in principle by the Ministry of National Defense in September 2021.
According to Doan Van Phuong, Chairman of the People's Committee of Quang Son Commune: “Currently, the land has been handed over to the local authorities for management and use according to the plan. It is expected that in December 2025, the commune will hold a meeting with residents to review eligible households, compile a list, and guide people through the procedures to update data in the public administrative center. Once completed, land will be allocated simultaneously to eligible households through land allocation, not through the issuance of land use right certificates as before. Accordingly, each household will be allocated a maximum of 400m2 of residential land and no more than 1 hectare of production land, and must pay land use fees and charges as stipulated. The land allocation will be completed in the first quarter of 2026.”
