The person who wants to be proposed for special amnesty must meet the following conditions: having made a lot of progress, having a good sense of reform, and being classified as having served the prison sentence fairly or well according to the provisions of the law on the enforcement of criminal judgments, having completed the additional penalty of a fine, having paid court fees, having fulfilled the obligation to return property, compensate for damages, and other civil obligations for those sentenced to prison for corruption crimes or other crimes decided by the President in each special amnesty. People who are suffering from serious illnesses, people who are often sick and cannot take care of themselves, when committing a crime are people under 18 years old, except in prescribed cases, people aged 70 years or older, people with especially difficult family circumstances and are the sole breadwinners in the family, pregnant women or women with children under 36 months old living with their mothers in prisons, temporary detention camps, temporary detention houses. Along with people with severe disabilities or especially severe disabilities according to the provisions of the law on people with disabilities; people with difficulty in cognition and behavior control according to the provisions of the law on civil matters. When granted amnesty, they must not have negatively affected security and order, and have made great achievements during the time of serving their prison sentences, with confirmation from the prison, temporary detention camp, criminal enforcement agency of the district-level police or other competent authorities. For people with serious illnesses who are suffering from one of the life-threatening diseases such as terminal cancer, paralysis, leprosy, drug-resistant tuberculosis, cirrhosis with ascites, heart failure of stage 3 or higher, kidney failure of stage 4 or higher, HIV infection that has progressed to AIDS or other diseases with a written confirmation from a medical examination and treatment facility from the district level or higher confirming that it is a serious disease according to the regulations of

However, people with serious illnesses who are serving a fixed-term prison sentence will not be proposed for special amnesty in cases such as being sentenced to prison for treason, activities aimed at overthrowing the people's government, espionage, violations of territorial security; riots; Crime of terrorism against the people's government, crime of sabotage of material and technical facilities of the Socialist Republic of Vietnam, crime of making, storing, disseminating or propagating information, documents and items against the Socialist Republic of Vietnam, crime of disrupting security, crime of sabotage of detention facilities; crime of terrorism or one of the crimes specified in the Chapter on crimes against peace, crimes against humanity and war crimes of the Penal Code. The judgment, part of the judgment or decision of the Court against that person is being protested under the procedure of cassation or retrial in the direction of aggravating criminal liability, is being prosecuted for criminal liability for another crime, has been previously granted amnesty, has 02 or more previous convictions. In addition, the person granted amnesty also has the rights and obligations such as being informed of policies and laws on amnesty, being notified of amnesty decisions, guidance documents from competent authorities on the conditions of the person proposed for amnesty and other information on amnesty related to the person proposed for amnesty, contacting relatives to collect necessary papers and documents for completing the amnesty application, requesting competent agencies, organizations and individuals to issue and confirm necessary papers and documents for completing the amnesty application, providing papers and documents as requested by the competent authority proposing amnesty; fully and honestly declaring personal information related to the amnesty application.
