New points expected to be revised to manage diplomas and certificates

The Ministry of Education and Training has just announced a draft Circular promulgating the Regulations on diplomas and certificates of the national education system, replacing Circular No. 21/2019/TT-BGDDT dated November 29, 2019.

The draft consists of 24 articles (10 articles less than the previous regulation), completed in a concise manner, clearly defining people, tasks, and responsibilities, ensuring consistency, feasibility, and suitability with practical requirements as well as the current trend of digital transformation in education .

One of the highlights of the draft Circular is the institutionalization of the digital transformation policy in education. The draft adds the concept of digital diplomas and certificates, along with specific regulations on the issuance, storage, processing and exploitation of the electronic diploma and certificate database, creating a solid legal basis for the implementation of digital diplomas and certificates nationwide. Issuing digital diplomas and certificates at the same time as paper diplomas will help modernize the management process, save time and costs, and at the same time meet the requirements of publicity, transparency and digitalization under the direction of the Party and Government .

The draft Circular also aims at changes when three Law projects (Law on Education, Law on Higher Education, Law on Vocational Education) are amended, supplemented and replaced in the near future. Specifically, replacing the issuance of Junior High School diplomas with confirmation of completion of Junior High School program in the transcript; supplementing Vocational High School diplomas; supplementing the form of digital diplomas and digital certificates; supplementing the scope and subjects of regulation to include diplomas and certificates of vocational education.

The draft Circular clearly defines the roles, responsibilities and authorities of agencies and units in the education system. Accordingly, the Ministry of Education and Training focuses on promulgating regulations, inspection and supervision, not on behalf of localities; the Department of Education and Training and the competent authority to issue diplomas and certificates are empowered to proactively organize implementation in accordance with their functions and tasks.

Specifically, the draft Circular removes the regulation on printing of diplomas and certificates of the Ministry of Education and Training, decentralizing to the Department of Education and Training or assigning to the competent authority to issue diplomas and certificates (for paper diplomas and certificates). In addition, the form of college and intermediate diplomas, the form of certificates of the national education system prescribed in current documents is replaced by the regulation on the main content recorded on diplomas and certificates; the form of original diploma books, appendixes of original diploma books, books for issuing copies from original books... are replaced by the regulation on the main content recorded on these books. The above regulations aim to increase the autonomy of competent authorities to issue diplomas and certificates in managing diplomas and certificates.

The draft also clearly demonstrates the spirit of administrative reform, cutting down on documents, paperwork, time and costs for people, aiming to resolve administrative procedures through the online public service portal. Accordingly, the time limit for issuing a high school diploma (paper) is reduced from 75 days to 30 days; the time limit for issuing a digital certificate is only 5 days from the date of the graduation recognition decision.

The draft adds more practical and flexible regulations such as allowing the authorization of deputies to sign certificates to reduce workload, clearly stipulating how to handle special cases (merger, separation, dissolution of the issuing agency or no longer having the authorized person according to regulations).

These adjustments aim to remove difficulties and obstacles from practice, ensure the rights of learners, minimize complaints and recommendations, and at the same time improve transparency and efficiency in state management of diplomas and certificates.
