Clearly define the responsibilities of the subjects in paying health insurance according to the new regulations

The Law amending and supplementing a number of articles of the Law on Health Insurance (amended Law on Health Insurance in 2024) and Decree No. 188/2025/ND-CP detailing and guiding the implementation of the amended Law on Health Insurance have specific provisions on the responsibility to pay health insurance.

Regarding the responsibility of paying health insurance: The 2024 Health Insurance Law and Decree No. 188/2025/ND-CP have clearly defined the responsibilities of the subjects in paying health insurance, towards ensuring a stable source of health insurance funds and optimal benefits for participants.

Group paid or jointly paid by employer or employee

- Employees working under contract; cadres, civil servants, public employees; part-time workers at the commune level; employees who are foreign citizens working in Vietnam: Employers pay 2/3, employees pay 1/3.

- Unsalaried business managers and controllers; Registered business owners: Self-pay.

- Defense workers and civil servants, police workers; people working in other key organizations and their relatives: Decree No. 188/2025/ND-CP stipulates that employers of these subjects are responsible for paying.

- Officials, civil servants, and public employees who are detained/temporarily detained/temporarily suspended from work or position without being disciplined: The employer and the employee jointly pay at a rate of 2/3 - 1/3 of over 50% of the monthly salary used as the basis for social insurance payment of the month immediately preceding the detention, temporary detention or temporary suspension according to the provisions of law. If the conclusion is that there is no violation, the amount of salary that is paid in arrears will be paid.

Group paid by social insurance agency

- People receiving monthly pension, monthly disability allowance, unemployment allowance, monthly occupational accident and disease allowance, long-term sickness or maternity allowance.

- Retired commune, ward and town officials receive monthly social insurance benefits.

Group funded by the state budget

- People's army officers, professional soldiers on active duty; professional officers, non-commissioned officers and technical officers and non-commissioned officers working in the people's police force; people doing cryptographic work receiving salaries as military personnel; relatives according to regulations.

- Non-commissioned officers and soldiers of the People's Army on active duty; non-commissioned officers and soldiers on duty in the People's Police; military/police/cryptographic students receiving living allowances who are Vietnamese; relatives according to regulations.

- Students: military, police, and cryptography receive living expenses as foreigners.

- Cadets training as reserve officers for 3 months or more have not participated in social insurance and health insurance.

- Standing militia.

- People with revolutionary contributions as prescribed; war veterans; relatives of martyrs, people with revolutionary contributions as prescribed; relatives of people with revolutionary contributions, wives or husbands of martyrs who remarry or have other wives who are receiving monthly survivor benefits and related individuals as prescribed.

- Incumbent National Assembly deputies and People's Council deputies at all levels.

- Children under 6 years old.

- People who have donated human organs according to the provisions of law.

- Foreigners studying in Vietnam are granted scholarships from the Vietnamese State budget.

- People from poor households; ethnic minorities from near-poor households residing in communes and villages in ethnic minority and mountainous areas; ethnic minorities residing in areas with difficult socio -economic conditions; people residing in areas with especially difficult socio -economic conditions; people living in island communes and island districts.

- Retired commune, ward and town officials who are receiving monthly allowances from the state budget.

- People who have stopped receiving allowances for loss of working capacity and are receiving monthly allowances from the state budget; people who are receiving monthly social allowances; people who are receiving monthly nursing allowances according to the provisions of law; people who are receiving monthly death benefits but are eligible for social allowances; people aged 75 and over who are receiving monthly death benefits, people aged 70 to under 75 from near-poor households who are receiving monthly death benefits; people who are receiving monthly social pensions; workers who are not eligible for pensions and are not yet old enough to receive social pensions and are receiving monthly allowances.

Groups supported by the state budget for contribution level

People from near-poor households; students; people participating in security and order protection forces at the grassroots level; people from farming, forestry, fishery and salt-making households with average living standards; medical staff in villages and hamlets; non-professional workers in villages and residential groups; ethnic minorities in communes that are no longer in difficulty; People's Artisans, Meritorious Artisans; victims of human trafficking.

These subjects pay a part themselves and are supported by the state budget for a part of the contribution. The collection of the participants' contributions and the proposal for the support budget will be periodically carried out by the social insurance agency or the representative of the household. The Department of Finance is responsible for transferring the support funds from the local budget.

Self-pay health insurance group

People in households participating in health insurance as a household; people living and working in organizations, charitable and religious establishments; employees on unpaid leave or on temporary suspension of labor contracts; other subjects not in the above groups: Self-pay the entire contribution.

Determine the order of health insurance payment in case one person belongs to many different categories at the same time

General principle: Pay health insurance according to the first subject that the person is identified in the order of subjects prescribed in Article 12 of the Law on Health Insurance 2024.

Special cases: There are specific regulations on priority order or selection of participants, to ensure the highest benefits for participants. For example, people belonging to many subjects receiving state budget support for contribution levels can choose to participate according to the subject with the highest support level.
