Quang Nam issues 'ultimatum' to Bach Dat An

Recently, the Department of Planning and Investment of Quang Nam province responded to the content of Official Dispatch No. 115/2023/CV-Cty dated July 27, 2023 regarding the consideration to resolve the extension of the implementation progress of projects invested by Bach Dat An Joint Stock Company (5th time).

Accordingly, after reviewing, the Department of Planning and Investment of Quang Nam province said that the housing construction investment projects invested by Bach Dat An Joint Stock Company, including: Bach Dat Urban Area, 7B Urban Area Expansion, Hera Complex Riverside Urban Area, Dien Duong Residential Area and Market, Sentosa Riverside Urban Area, An Cu 1 Residential Area, 7B Urban Area, Bach Thanh Vinh Urban Area, Bach Thanh Vinh Urban Area Expansion, have now finished the project implementation schedule.

Bach Dat An Joint Stock Company has prepared a dossier requesting an extension of the project implementation schedule. Based on the investor's request for an extension of the project schedule, the Department of Planning and Investment has sent a document to solicit opinions from relevant units and compiled a report for the Provincial People's Committee to consider.

During the process of consulting on extending the progress of projects invested by Bach Dat An Joint Stock Company, the Department of Planning and Investment found that the enterprise did not comply with the direction of the People's Committee of Quang Nam province on transferring compensation funds and supporting site clearance; did not fulfill tax obligations as prescribed; did not perform the deposit and additional deposit work to ensure project implementation in accordance with regulations as requested by the Department of Planning and Investment.

Many problems exist in a series of projects of Bach Dat An Joint Stock Company.

In Official Dispatch No. 3711/CTQNA-QLN dated May 19, 2023, the Provincial Tax Department requested the Department of Planning and Investment to take measures to revoke the business registration certificate issued by the Department of Planning and Investment of Quang Nam province to Bach Dat An Joint Stock Company. Reason for the revocation request: The taxpayer has tax arrears over 90 days from the due date as prescribed.

Based on the request of the Provincial Tax Department, on June 27, the Business Registration Office (Department of Planning and Investment) sent a notice to Bach Dat An Joint Stock Company about the violation of the enterprise in the case of revoking the business registration certificate. Accordingly, the Business Registration Office requested the legal representative of the enterprise to come to the office's headquarters to explain within 30 days from the date of signing the notice.

After 10 working days from the end of the deadline stated in the notice, if the requested person does not appear or the explanation is not accepted, the Business Registration Office will issue a decision to revoke the business registration certificate.

Meanwhile, according to the Quang Nam Provincial Tax Department, up to now, Bach Dat An Joint Stock Company still owes taxes of 15,535 billion VND.

This is considered the biggest real estate dispute in the Central region with about 1,100 plots of land sold, earning about 700 billion VND.
After many trials from the first instance to the appeal, the People's Courts at all levels rejected the lawsuit of Bach Dat An Joint Stock Company, forcing this enterprise to continue to perform the contract, quickly deploy the projects, hand over land and red books to the people. However, up to now, the investor has not yet handed over land and land use right certificates to customers who bought land at the project.
