The National Assembly discussed three draft laws on Enterprises, Planning Law and Law on Economical and Efficient Use of Energy.

Continuing the program of the 9th Session, the 15th National Assembly, on the afternoon of May 10, the National Assembly discussed in Groups: Draft Law amending and supplementing a number of articles of the Law on Enterprises; Draft Law amending and supplementing a number of articles of the Law on Planning and Draft Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy.

At Group 6, National Assembly Delegate Le Thi Ngoc Linh (Bac Lieu delegation) gave her opinion on the draft Law amending and supplementing a number of articles of the Enterprise Law. According to the delegate, the scope of the law is quite broad. The delegate proposed that only articles and clauses that encounter difficulties, obstacles, and inadequacies during the implementation process in practice should be adjusted and supplemented; while articles and clauses that do not encounter difficulties or obstacles should remain the same, avoiding the situation of too many amendments that will affect other Laws. For example, the regulations on the head office of enterprises (in Article 42), regulations on state-owned enterprises (Article 88)... (on the form of organization, or the ratio of capital ownership or classification of enterprises...) need to be adjusted and supplemented or not, the Drafting Committee is requested to consider further. In addition, the Draft Law amending the Law does not stipulate documents proving financial capacity to carry out procedures for establishment, capital contribution, and reduction of capital contribution at enterprises. This is a new policy, aiming to create a transparent and favorable mechanism for businesses; at the same time, it can also reduce costs for businesses. This issue is also consistent with Conclusion 119 of the Central Committee and Resolution 66 of the Government. However, the above regulations also need to be inspected, monitored and sanctioned. Delegates suggested that the Government should have specific and strict regulations and have strict sanctions against businesses that take advantage of this regulation to deliberately circumvent the law and violate the law.

Delegate Ngoc Linh also proposed that the proposed amendments and supplements at Point b, Clause 2 and Point b, Clause 3, Article 17 of the Enterprise Law on the right to establish and contribute capital to establish enterprises are excluding "Civil servants and managers working at public scientific and technological organizations and public higher education institutions according to the provisions of the law on science, technology and innovation", and there are no criteria associated with enterprises established by these organizations to commercialize the results of scientific research and technological development, which does not ensure the right institutional spirit of Resolution 57 of the Central Committee.

* Regarding the draft Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy (EEE), National Assembly Deputy Nguyen Huy Thai - Deputy Head of the Delegation of National Assembly Deputies of Bac Lieu province had many comments for the draft. In particular, with the regulation on the Fund for promoting economical and efficient use of energy in Clause 17, Article 1 of the draft Law (amending Clause 2, Article 41 of the current Law), the delegate agreed with the opinion of unanimity to establish the Fund because the Fund for promoting economical and efficient use of energy is a state financial institution, established at the Central level, assigned to the Ministry of Industry and Trade for management, the Prime Minister decides on the establishment, organization and operation of the Fund.

Through studying the Project on establishing the Fund to promote sustainable and efficient use of natural resources, delegates found that: The Fund has a separate purpose, ensuring social goals, specifically promoting sustainable and efficient use of natural resources. The establishment of the Fund is aimed at both increasing the attraction of investment capital from the private economic sector and mobilizing additional financial resources outside the state budget, promoting economic growth and social development; creating more tools to better perform the State's role of macro-management, overcoming the shortcomings of the market economy. The Fund also promotes SDNLTK&HQ with the function of providing preferential interest rate loans, funding, and interest rate support for enterprises to invest and change production lines to reduce energy consumption intensity in production and business, meeting compliance requirements of prescribed standards... The issue raised here is to propose clearer and more specific regulations for some basic contents related to the establishment, management, objectives, tasks, financial mechanisms and use of the Fund in the draft Law as a basis for the Government to stipulate in detail and guide implementation.

The delegates also recommended that most of the policies in the draft Law encourage individuals, organizations, households, etc. to implement energy saving and efficiency. Therefore, it is necessary to study and supplement regulations on rewards for organizations and individuals who perform well in energy saving and efficiency according to the provisions of the law on emulation and rewards; propose to supplement the regulation "There are preferential policies to support small and medium enterprises, enterprises operating in difficult and especially difficult areas to implement the Energy Saving and Efficiency Program"; "There are policies to encourage enterprises operating in difficult and especially difficult areas to invest and switch to the production of energy-saving products, reducing greenhouse gas emissions through credit support mechanisms, green credit".
