Continuing the National Assembly's working program, on the afternoon of May 20, the National Assembly discussed in groups to give opinions on the Draft Penal Code (amended); Draft Law on amending and supplementing a number of articles of the Criminal Procedure Code and Draft Law on amending and supplementing a number of articles of the Law on Credit Institutions. Group 6 includes the National Assembly delegations of Soc Trang, Binh Dinh, Ha Giang and Bac Lieu provinces, headed by Comrade Lu Van Hung - Member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Bac Lieu province.
Head of Group 6, Comrade Lu Van Hung - Member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Bac Lieu province gave a speech suggesting discussion on the afternoon of May 20.
Speaking to suggest group discussions, Comrade Lu Van Hung suggested that the National Assembly deputies focus on discussing and giving opinions on issues related to the three draft laws mentioned above. In particular, the chairman suggested that the deputies focus on studying and giving opinions on issues related to the necessity of amending and supplementing a number of articles of the Penal Code; the Criminal Procedure Code; the suitability of the contents of the draft laws with the Party's policies and guidelines; the constitutionality, consistency with the legal system and compatibility with international treaties to which Vietnam is a member. Regarding the Penal Code, pay attention to provisions such as the proposed abolition of the death penalty for a number of crimes; adding life imprisonment without parole as the main penalty; increasing the level of imprisonment and fines for a number of crimes; Amending and supplementing a number of provisions of 4 laws: Amnesty Law, Criminal Enforcement Law, Human Trafficking Prevention and Control Law, People's Public Security Law in the draft Law amending and supplementing a number of articles of the Penal Code. Regarding the Criminal Procedure Code, attention should be paid to amending and supplementing provisions related to the arrangement and streamlining of the apparatus of the Investigation Agency; agencies assigned to conduct a number of investigation activities (Border Guard, Coast Guard, Customs, Forest Ranger, Fisheries Inspectorate); People's Procuracy; People's Court; supplementing the duties and powers of investigators who are assigned as Chief of Police (or Deputy Chief of Police) at the commune level; jurisdiction of the People's Court of the region; procedures for reviewing death sentences before execution. In addition, regarding the Draft Law amending and supplementing a number of articles of the Law on Credit Institutions, it is recommended that delegates focus on discussing regulations related to the authority to decide on special loans with an interest rate of 0%/year, without collateral; the right to seize collateral; the seizure of assets of judgment debtors being used as collateral for bad debts; and other issues that National Assembly delegates are interested in.
Commenting on the discussion group, regarding the draft Penal Code, National Assembly Deputy Tran Thi Hoa Ry - Vice Chairwoman of the National Assembly's Ethnic Council , the National Assembly Delegation of Bac Lieu province suggested that the drafting agency pay attention to the regulation of life imprisonment without consideration for sentence reduction, which will lead to a burden on society in terms of costs for prisoners serving life sentences, such as having to take into account the increase in facilities, human resources, and other costs, especially in the context of our country still developing, having difficulty in allocating enough budget, increasing investment in facilities, and other resources like developed countries related to these types of crimes. In addition, it is proposed to maintain the death penalty for the crime of manufacturing and trading in counterfeit drugs, which can lead to particularly serious consequences such as death or lifelong disability. Because through contact, voters are very upset with the situation of counterfeit goods on the market, suggesting that there should be stronger sanctions. In particular, these behaviors directly affect public health, especially the poor - who are easily tricked into buying fake drugs.
