Regulations on the level of deduction and use of funds deducted from amounts recovered through inspection

Specifically, the Government Inspectorate; ministerial inspectorates, general department inspectorates, departments and equivalents; provincial inspectorates; department inspectorates; district inspectorates; inspectorates at special administrative-economic units as prescribed by the National Assembly; inspectorates at government agencies; inspectorates in the military, police, State Bank, and Government Cipher.

The amounts deducted are State budget revenues illegally appropriated, seized, used or lost due to illegal acts; State budget expenditures that violate regulations, standards and norms and are recovered through inspection after being paid into the State budget.

The National Assembly Standing Committee voted to pass a resolution stipulating that inspection agencies are allowed to deduct a portion of the recovered money discovered through inspection after paying it into the State budget.

Regarding the deduction level, according to the resolution, the Government Inspectorate is allowed to deduct a maximum of 30% of the total amount paid to the State budget for amounts up to 50 billion VND/year; to deduct an additional maximum of 20% of the total amount paid to the State budget for amounts from over 50 billion VND to 80 billion VND/year; to deduct an additional maximum of 10% of the total amount paid to the State budget for amounts from over 80 billion VND/year.

Provincial inspectorates; ministerial inspectorates; inspectorates of general departments, units under ministries and equivalent; inspection agencies in government agencies; inspectorates in the military, police, State Bank, and government cryptographic agencies are entitled to deduct a maximum of 30% of the total amount paid to the state budget for amounts up to 10 billion VND/year; to deduct an additional maximum of 20% of the total amount paid to the state budget for amounts from over 10 billion VND to 20 billion VND/year; to deduct an additional maximum of 10% of the total amount paid to the state budget for amounts from over 20 billion VND/year.

District inspectors; inspectors at special administrative-economic units as prescribed by the National Assembly; department inspectors are entitled to deduct a maximum of 30% of the total amount paid to the State budget for amounts up to 2 billion VND/year; are entitled to deduct an additional maximum of 20% of the total amount paid to the State budget for amounts from over 2 billion VND to 3 billion VND/year; are entitled to deduct an additional maximum of 10% of the total amount paid to the State budget for amounts from over 3 billion VND/year.

The use of this allocated fund is also clearly stated in the resolution.
