Reduce administrative procedures, strengthen post-inspection

Continuing the 9th Session, on the morning of May 6, under the direction of Vice Chairman of the National Assembly Le Minh Hoan, the National Assembly listened to the Presentation and Verification Report on the draft Law on Science , Technology and Innovation.

Accordingly, promoting the simplification of administrative procedures in science, technology and innovation activities is one of the key contents of this Law project.

Developing science and technology, innovation, and digital transformation will be key factors in building a modern, democratic, transparent, professional, scientific, and effective National Assembly .

Referring to the necessity of promulgating the Law on Science, Technology and Innovation (S&I), authorized by the Prime Minister, Deputy Prime Minister Le Thanh Long said that over the past 10 years, the 2013 Law on Science and Technology has played an important role in creating a fundamental and important legal corridor for continuing to strongly and synchronously innovate the organization, management mechanism, and operation mechanism of S&T.

On that basis, science and technology have made positive progress, making practical contributions to socio-economic development and have been demonstrated through many outstanding results. However, the implementation of the 2013 Law on Science and Technology shows that the current law still has contents that are not suitable to the requirements and demands from practice for the development of science, technology, and socio-economic development.

The draft Law on Science, Technology and Innovation consists of 8 chapters and 83 articles (2 articles more than the 2013 Law on Science and Technology due to the addition of innovation content and restructuring of the Law, so the form has many changes compared to the current law).

According to Deputy Prime Minister Le Thanh Long, the draft Law on Science, Technology and Innovation closely follows the policy contents in Resolution 118/NQ-CP dated August 3, 2024 of the Government on the thematic meeting on law making in July 2024 (reported to the National Assembly Standing Committee), specifically:

The draft Law is designed based on the principles of reducing administrative procedures, strengthening post-inspection, and comprehensive digital transformation in the management and operation of science, technology and innovation.

Change management thinking towards effective management, not process management. Attract non-state budget investment for science and technology by encouraging businesses to invest and fund scientific research and technology development.

Maximally inheriting the contents of the 2013 Law on Science and Technology which has been effectively implemented in the past and is suitable for the current requirements of science, technology and innovation development.

Clearly define talent criteria

On behalf of the review agency, Chairman of the Committee for Science, Technology and Environment (KH,CN&MT) Le Quang Huy affirmed that the Committee basically agrees with the viewpoint of law-making; proposes to more closely follow and fully institutionalize the spirit of Resolution No. 57-NQ/TW.

Mr. Huy also suggested that the law should more clearly demonstrate the role of enterprises, the private economic sector, and the "doctrine" of development in the field of science, technology and innovation; have breakthrough and outstanding regulations; promote decentralization, delegation of power, and simplification of administrative procedures; and focus on policies to create synchronous development with management according to appropriate mechanisms.

The draft law dossier basically meets the requirements as prescribed and is eligible to be submitted to the National Assembly.

Regarding the organization of science, technology and innovation, some opinions suggested considering not continuing to define "academy" as a form of science and technology organization; researching and supplementing regulations on the construction and promotion of interdisciplinary research centers, integrating social sciences and humanities with natural sciences and engineering because it has now become the central driving force of the sustainable innovation ecosystem.

The Committee recommends clarifying the legal status of higher education institutions as S&T organizations, clearly distinguishing them from affiliated S&T organizations, ensuring consistency with the Law on Higher Education.

Regarding the development of human resources, talents in science, technology and innovation, the Committee on Science, Technology and Environment proposed to study regulations on building training programs for high-level research human resources and new technological skills.

The law needs to have a mechanism for rotating scientists between institutes - schools - enterprises, and a mechanism to attract international experts and Vietnamese experts abroad to participate in strategic programs, projects, plans, and tasks of science, technology and innovation.

The Committee also proposed reviewing and researching additional regulations on criteria for experts and talents; providing adequate and appropriate regulations on rights and obligations, especially autonomy in expertise, personnel and finance. There should be regulations to encourage the implementation of STEM and STEAM education programs; and policies to promote the building of a creative culture.
