At the discussion session, many National Assembly deputies agreed with the provisions of the draft Law on the Execution of Criminal Sentences (amended), on the right of prisoners to donate tissues and body parts; and to store eggs and sperm. This demonstrates profound humanity and humanity, while also creating opportunities for prisoners to contribute to their families and communities.

Delegate Pham Van Hoa ( Dong Thap Delegation) emphasized that the issue of prisoners being allowed to donate human tissues and organs is very necessary if later, their relatives have illnesses that require donation. However, the delegate also noted the need for strict regulations.

“Tissue donation is only allowed not for profit, not for economic reasons; the recipients of tissue donation are relatives and family members of the donor,” said delegate Pham Van Hoa , emphasizing that such regulations must have very strict conditions attached to them to avoid legal procedures arising later.

Delegate Pham Van Hoa also noted that prisoners donating tissue also need to undergo a health check. "Therefore, there must be specific regulations and conditions and must be forensically examined by the medical team," the delegate emphasized.

Expressing agreement with the opinions of many other delegates, delegate Huynh Thanh Phuong (Tay Ninh delegation) said that the subjects donating human tissues and organs in this case are very special, being prisoners, people serving sentences, and very sensitive.

“Without a comprehensive assessment, the drafting agency should consider not yet considering including it in the law. If the draft law is still kept as it is, I suggest that other conditions should be closely assessed,” said delegate Huynh Thanh Phuong.

Prisoners are allowed to donate tissues and body parts voluntarily.

At the end of the discussion session, General Luong Tam Quang, Politburo member and Minister of Public Security, gave a speech explaining and fully absorbing the opinions of National Assembly deputies on these two draft laws.

Minister Luong Tam Quang said that these two draft laws were developed to institutionalize the viewpoints of our Party and State on perfecting and organizing the political apparatus and the mechanism for executing sentences, carrying out temporary detention and imprisonment.

In particular, the draft laws ensure consistency with the process of building and perfecting the socialist rule-of-law state in the new period; thereby overcoming practical difficulties and shortcomings, meeting the requirements of innovative thinking in law-making work.

Regarding the right to donate tissues, body parts and sperm storage of prisoners, Minister Luong Tam Quang said that, taking into account the opinions of National Assembly deputies, the drafting agency will coordinate with the reviewing agency to revise the draft law on the basis of the following principles: Prisoners are allowed to donate tissues and body parts when they voluntarily do so, are in good health to donate and are healthy enough to continue serving their sentence after donating. Prisoners must bear the costs related to the donation and their own health care after donating; the recipient must be a relative of the prisoner. At the same time, the regulation applies to people convicted for the first time of a less serious or serious crime but with less than 3 years left to serve their sentence.

Regarding the right to store sperm of prisoners, some opinions said that this is a humane and progressive regulation, but it is difficult to implement due to high medical technical requirements, high costs, and difficulty in implementation in detention facilities. The Minister accepted the opinions and said that the drafting agency will coordinate with the reviewing agency to study and consider carefully before reporting to the National Assembly for approval.

Regarding the Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving the Place of Residence, the Minister said that the drafting agency proposed assigning the Commune Police Chief to directly assist the Commune People's Committee in managing and monitoring people subject to the preventive measure of "prohibition from leaving the place of residence".

Regarding the National Assembly delegate's proposal to add regulations for border posts located in remote areas, the law currently stipulates the arrangement of temporary detention areas at some posts. However, the Ministry of Public Security will review and add regulations in the direction that border posts in areas far from detention facilities are allowed to organize temporary detention cells for management; ensuring clear planning and decentralization, not expanding indiscriminately.

According to the Minister, currently, the commune-level police have not been allocated temporary detention and temporary detention cells. Therefore, the Ministry of Public Security is re-planning the detention facility system, only proposing to arrange them at the special zone police station, while other units will not have their own temporary detention cells.
