Speaking at the Hall on the Law on the Execution of Criminal Sentences (amended), delegate To Van Tam (Quang Ngai delegation) proposed allowing prisoners to send wages back to their families, in addition to the regulation "sending them to the prison for management and receiving them back after completing their prison sentence".

On the morning of November 12, continuing the working program, the National Assembly discussed at the Hall the Law on the Enforcement of Criminal Judgments (amended). The revised Law Project aims to adjust the organizational model of the criminal judgment enforcement system to suit the new organizational structure. At the same time, it supplements regulations to ensure human rights, civil rights, application of science , technology, and biometric data in management and enforcement of judgments.

The draft Law (amended) also completes regulations on the implementation of rights and obligations of persons serving criminal sentences, the management regime for persons serving criminal sentences, regulations on the implementation of the detention regime for prisoners; ensuring consistency and uniformity with other relevant specialized legal provisions.

Notably, the draft Law on Enforcement of Criminal Judgments (amended) adds that prisoners have the right to donate tissues and body parts; enjoy the regime and policies according to the law on donation of human tissues and body parts; and have eggs and sperm stored according to the law (Clause 1, Point b, Article 23). This is a new content added compared to the current Law.

Regarding this, the draft Law received many opinions of high consensus from delegates. Speaking at the discussion in the Hall, delegate To Van Tam ( Quang Ngai delegation) affirmed that this is a humane and humane regulation, demonstrating progress and civilization, reflecting respect for basic human rights even when they are serving their sentences . "This demonstrates the humaneness and humanity in our country's criminal management thinking, which is not only punishment but also education, reformation and respect for human dignity," the delegate emphasized.

However, according to delegates, these regulations need to be further clarified to be more strictly regulated in order to create conditions for prisoners and relevant agencies to exercise this right, as well as to avoid abuse of this right during the implementation process.

Regarding the settlement of wishes to donate human tissues and organs and store sperm, delegate To Van Tam said that in the draft Law (amended) Article 53, there is a provision "Resolving cases where prisoners wish to donate human tissues and organs" but there is no provision on how to resolve the wish to store eggs and sperm? Therefore, the delegate suggested that the Drafting Committee add more conditions for resolving wishes to make the regulations more complete and the implementation process more effective.

Regarding the regulations on the use of labor results of prisoners (Articles 29 and 30), according to the draft Law, prisoners can use or "send them to the prison for management and receive them back when they have completed their prison sentence", delegate To Van Tam proposed allowing prisoners to send money back to their families.

Explaining this proposal, according to the delegate: In reality, there are prisoners whose families have the means to send money to the prison for prisoners. But there are also prisoners whose families are very poor. "Therefore, when we organize labor for them to have a legitimate income, we should also allow them to send money back to their families, to help overcome the consequences as well as the difficulties with their families ," the delegate stated.

In response to the opinions of the National Assembly deputies, on behalf of the Drafting Agency, Minister of Public Security Luong Tam Quang emphasized that the drafting agency will coordinate with the reviewing agency to revise the draft Law on the basis of the principle that prisoners are allowed to donate tissues and body parts when they meet the following conditions: Voluntarily donate tissues and body parts; have sufficient health conditions to donate tissues and body parts and ensure health to continue serving the sentence after donating tissues and body parts; must bear the costs of donating tissues and body parts, and take care of their own health after donating tissues and body parts; people convicted of less serious crimes or serious crimes in the case of first-time offenses and the remaining sentence period is less than 3 years; donate tissues and body parts to relatives of prisoners.

Regarding the right to store eggs and sperm of prisoners, in response to the opinions of delegates that it should not be regulated in the law because it lacks feasibility because it requires high medical technology, high costs, and is difficult to implement in detention facilities, Minister of Public Security Luong Tam Quang said that the drafting agency will receive opinions, coordinate with the reviewing agency to research and carefully consider before submitting the draft Law to the National Assembly for consideration and approval.
